damaged ebay item, please help

quick question for all you ebay people. I bought a fair amount of stuff on ebay and have had fairly no problems. recently i bought a devern hansack sp by the letter card. i got a pretty good buy it now price of 5.99 + 2.95 s/h. i received the item in a an envelope a little thicker than normal but same size as a business envelope with postage of .58 on it. i open the package and the seller put the card in a penny sleeve and taped a piece of white cardboard to the back of the sleeve (for support i guess). after removing tape and penny sleeve the corners are a little damaged and there is an indentation at the top from the tape. nothing super major but i am not happy. i sent the seller a message:

"i received this card today, unfortunately this card was shipped very poorly, no case or top loader and the top of this card and corners now have dmg due to poor shipping. I wanted to let you know as i am considering leaving negative feedback."

i wanted to get my point across but let him know i was not happy, he responds with this:

"I am sorry you feel that way. That card would not fit into a regular top-loader. The decision is yours, but remember what you give is what you receive."

this ticks me off, i did nothing wrong and was hoping to resolve this issue so i sent this
"there are special top loaders made for these type of cards. i am not quite sure why i would deserve a negative feedback as i have done nothing wrong, this card at least could have been shipped in a bubble mailer. I would like to work something out about it but it doesnt appear, you care about the condition or shipping of the card."

he hasnt and probably wont respond, what would you guys do?

    I would eat the $10, and chalk it up to forced consciousness expansion.
  • yeah, like i said the amount is not a big deal, principle ticks me off....

    i have never seen something shipped so poorly.

    Then you have either a) not been buying on Ebay very long, or b) have enjoyed a run of luck that would rival the run experienced by Archie Karras.
  • been on ebay since 01, just started buying cards again in early 07, but i sell a bunch and buy a lot of random things... and i would rather be lucky in pack breaks than ebay shipping sometimes.

    Well, I can certainly relate to the notion of buying a lot of random things, since that's what fills my 'Ebay cart' on any given weekend.
  • $10 isn't worth a negative feedback. Chalk it up as a learning experience and move on.

    Your mistake was telling the seller you may neg him.

    You may have received some sort of refund had you simply asked.

    Once you left the threat of leaving a negative you opened yourself up to

    retaliation and no remedy.

    Had you given a seller like this a negative what could they say in reply in theirs?

    Bad buyer he expects proper shipping??

    Poor taste to threaten leaving negative feedback if you wanted him towork with you, IMO.

    Of course, he may have said tough anyway, but...

    For $6, I wouldn't lose any sleep over it, though.

    On the plus side, sellers like him won't be able to utilize that FB extortion thingy come May. image

    I would file a SNAD with EBAY.

    If PayPal is in the mix, I would file a dispute/claim.

    YOU lost the high-ground with the NEG threat.
    A refund request would have had a 50/50 shot
    at a favorable outcome; the threat took that
    off the table. MANY sellers have been over-extorted
    in the past two years, and it just doesn't work
    as well as it once did.

    IF you have similar problems in the future, simply
    ask the seller to do whatever it is that will satisfy
    you.

    eg: "The item arrived damaged due to poor
    packaging. I am returning the damaged item to
    you today. Please issue my refund upon receipt
    of the damaged item. Thank you."

    (Use Delivery Confirmation on all returns.)

    BUT, the seller is a scumster. After you get your
    refund, I hope you NEG his sorry butt for his poor
    shipping practices.

    NEGs do no harm to buyers.

  • yeah, looking back on it, i should have not threatened the negative, but i was hoping that would bring a quicker resolution or them want to help out, my mistake i was wrong. unfortunately a neg would do harm to me as i buy and sell... thanks for the advice folks

    It might be worthwhile to consider getting a seperate
    account that is used only for buying.

    OTOH, if the May scheme goes into effect, sellers will
    no longer be able to leave NEGs. Not even for bad buyers.

  • Well...your original mail to him did not come off as trying to rectify the problem, with a possible rebate or anything. You basically lambasted him and then threatened him with a neg. If you had used a little more tact in the original mail, he may even have given you a full refund. But you slammed the door on that one. If I had received that kind of mail from someone, my back would have gone up as well.

    Next time, read, hesitate, and re-read what your going to send. Then put yourself in the recipients place and ask yourself how you would feel.

    A little tact goes a long way in resolving issues.
  • Neg the guy and move on. This is another perfect example of why the new feedback scheme makes so much sense.

    You did everything you could do as a buyer will still probably get a retaliatory neg.
  • You need to leave some sort of feedback, whether it be negative, neutral, or positive. When doing so, make sure you fill out the extra information they now ask for about the buying experience and give him the lowest rating possible.
