You are supposed to work through paypal buyer protection, not your credit card company. The seller does not have a credit card merchant account, so the credit card company cannot take the money from the seller's account like a normal chargeback. They take it from Paypal, which had nothing to do with the fraudulant act. When a credit card company processes a chargeback (getting the money from paypal) they no longer have any incentive to cooperate with paypal in getting a refund through paypal's procedures.

At what point in a situation such as that given by the OP would someone at the CC company say this is not right and refuse to grant the chargeback?At what point could or should a person consider legal action against the CC company?
