Legality to bashing ebay sellers

I bought a rack case. It was resealed. If I fought for a refund I knew he would just rip someone else off. I opened it all up. In short, I found evidence the racks were resealed too. Pretty sad. Pic in auction showed the sealed case and one I got was opened and retaped. Pretty obvious it was done by current seller. I email him and tell him to end the cycle I will eat the $80 but cause him more harm by telling everyone an dleaving a neg to add to his 43. Yeah I know. He then proceeds to mention his lawyer friend. Does he have a case if I bash him here?

  • 1989 - I'm sorry to hear about this. It's sad to hear that someone with a lot of knowledge of what he/she is buying can still get ripped off. Your credibility on the subjects you post to would seeingly make you your own expert witness. And that's if the .00001 percentage that a resealling scumbag piece of crap that sells you junk would so feeble minded to call an actual attorney to find out what a retainer would be on something like this, knowing what had actually transpired. So you have no issues stating facts as long as you stay with that and not emblish. You are not only exempt from a slander/defimation lawsuit, you are once again doing us all a favor by helping to educate. And if I was such a piece of crap who actually did any resealing, I would not be too overly smug about auctioning and sending out any other tainted product lest it be used as evidence for anything.

    Anybody can sue anybody for anything. But as fraudulent as the courts can sometimes be with scumbag lawyers extorting money through the legal system from companies and individuals such as doctors with deep pockets which dramatically raises costs for the rest of us, it is economics which keeps even scumbag lawyers from suing too much. For example, even a scumbag lawyer won't take this case on a contingency basis because he would know he'd be wasting his time and money on secretarial costs, court costs, etc.

    Scumbag lawyers will attempt to suck their clients dry with retainer fees, etc., but this scammer, just to try to hassle you, isn't going to pay some scumbag lawyer $500 or more for a retainer fee and then more expensive fees as the scumbag lawyer drags out the case into perpetuity so that the scumbag lawyer keeps receiving his trumped up fees, especially when the scammer knows that you couldn't lose the case anyway because you told the truth and can prove the truth.

    So as long as you tell the truth...the bottom line to the best of my knowledge is the answer is he has no case if you bash him here...and realistically he's not going to sue you for the reasons stated. So fire away if you wish.

    Truth is a defense in a libel or slander action, but the truth is subjective in a situation like this and since the packs were apparently all opened, it is your word and his. If you live in different states, any action would be unlikely given the small chance of any meaningful recovery. It is highly unlikely any lawyer would take a case like this on a contigency basis because of the time involved in such cases and the iffy chances of a recovery, or at least a significant one. It would also be unlikely the seller would foot the bill to bring litigation, particulary if you live in another state. ( unless he is a rich fanatic) If he does have a lawyer aquaintance though, it is easy to get someone to write a demand letter, if he knows where to send it

  • bought a rack case So it was just the initial seal that was busted? Still you can pick out stars showing and if you know the sequence can can pul lall the stars. I dont know how they would reseal the racks

    I only mention this as I saw he has many other wax boxes for sell. Claims this box was a consignment and other box sold was problem free. Im currently talking with the other buyer as he still has his intact to see his situation.

    To the disgruntled CU member who leaks info on every situation to the other party. Feel free. Im not doing this to scam free Bill Ripkens as the seller claims I am.

    Partly my fault. 43 negatives but I wanted this rack case and it looked legit. Sadly I could of easily got a Paypal refund had I not opened it as it was quite obvious what was done but I didnt want another buyer to get stuck as they would of probally held onto it and later get themselves in trouble or open it later and get a unfair shake. I say they would of probally have held onto it as I email most 89 Fleer rack buyers to hear their contents and most say they're holding it.



    Fleer tape seal was busted. Had clear tape over it. Claimed he didnt tape box the P.O. did. Yeah 5k FB and and he has the P.O. seal his boxes. Claims he had a wax business at one time doing half a mil. Ok if your experienced for 30 years like you say why did the seal get taped over and come to me unlike pictured in the auction.

    In the case- One box had the racks all facing the wrong way. Iffy on this one. 1st for me in 15-20 89 Fleer rack cases.

    ALL of the racks were not sealed on the end. Not the header end but the other. Ok. maybe Fleer sealing problem.

    But I then noticed I opened a pack and one of the individually celophabed sections had part of the rack stuck to it. I remember the rack splitting open down the seal quite easily and nothing sticking. I then pay attention to this better. I find 2 more of these section with parts of the rack outer wrapper stuck to this section. It has words on it easily identified and the wrapper was intact. Same deal on another one.

    I think the collation paterns were used to cherry pick certain sections as I pulled 4-5 of everybody big but only 2 of the Bill Ripken. Sad thing is they were the Black Box (most common)

    The insides could be explained as Fleers poor sealing or Fleer opening packs to remove the FF (as I have heard this and once pulled a wax stain in a rack case) but my main "beef" is the outer seal. Pic in auction shows no extra tape on Fleer tape. I specify not to put tape over Fler tape. When I get it it has tape over Fleer tape and I carefully inspect it and remove (quite easily) this nerw tape to seal the seal undernath is busted and not just on the top from weight of another box on top but on both edges where the tape does down the sides of the box.
