eBay - Purchased Cards That Weren't Dlvd. It gets worse... Help

I've been dealing with a real loser eBay seller. I bought some cards off of him on the 12th (and immediately paid). A week later, I haven't heard from him so I file a claim. The guy makes up some excuses, but PayPal quickly finds in my favor. I then go back to eBay and buy the same cards (some A&G inserts I needed to finish my sets) from another seller. This time, I get a pretty good deal, I paid $100 originally, the second go around for the same cards, I'm only out $75. So all in all, a bit of hassle, but I saved some money, and now have my cards. All is well. Complete mini master set complete August 28th. Woo Hoo, etc.

Low and behold Sept. 1, the original cards show up at my door and now the original seller is demanding payment. Apparently, the guy shipped them after PayPal/eBay found in my favor figuring he could still back door the payment by going this route. I offered to mail them back, but he wants the money. Obviously, I don't want two of the same cards, and the market has even fallen further on these cards. Plus, I don't feel it's my responsibility to have to sell the 2nd (original) purchased cards.

    It seems like you jumped the gun.....one week to file a claim is rather quick in my mind.

    It's not quick to jump the gun. No contact is inexcusable. 10-12 days no contact, no cards, file the claim. The seller then has a 10 day clock to deliver the goods. After that your money is returned on <$2000 transactions.

    Return them, but only after he sends you Paypal payment for the return shipping charge.

  • You have to options you can send them back or keep them he cannot send them to you then demand payment. At the point the money was refunded to you anything he sent afterwards became unsolicited. I would send them back postage due, but you are under no legal obligation to do so.

    Keep this in mind - a seller can appeal a payment reversal if the goods are later delivered and there's proof of delivery. There's probably a time limit, but I doubt it's 20 days. If he has already done this (I'm not sure if they would notify you of an appeal unless they reversed their ruling), you could end up losing your cards and your cash if they rule on the appeal while the cards are in transit.

    so in theory a shipper could send you a empty package with tracking, after a claim has been filed just to get a delivery confirmation??

    Yep. The smart scammers used to do that all the time because paypal wouldn't let buyers open a not as described complaint after they opened a non-receipt complaint. Now buyers can appeal too, though.

    Had to pay the $$$ for the cards. Pretty much sucks. Carry on.

    FWIW, may not be the seller's fault, could have legitimately been a USPS screw up, but I doubt it. I won't be buying from: brentandbecca again.

    I hope you get this resolved, I was recently burned for $75 as well. I took a chance with a guy with low feedback and money orders.....yeah, I know.

    Somtimes having patience is a virtue. Maybe if you would have waited 2 weeks instead of 3 they would have been delivered. I have such low expectations from ebay sellers and buyers that if I receive payment or cards within a 3 week window I am happy.

  • I don't wait if I have not heard anything from the guy in about 10 days I file. The quicker you file the better your chances of recovering your money are.
  • Can't you just look at the postmark date on the envelope and tell which day they were mailed? Wouldn't this tell you if they were mailed before you filed your claim or after?

    Filing a Paypal claim one week after payment is far too premature, IMO.

    Many sellers do not communicate (or send invoices for that matter), but I wouldn't say that means they are going to rip you off.

    I've had packages sent via priority mail take up to 2 weeks to arrive, so filing a Paypal claim in 7 days (the absolute minimum Paypal allows, BTW, and that ought to be changed) and freezing his funds while the package may be in transit is very unfair.

    You have 45 days to file a Paypal claim for non-receipt. Plenty of time, in other words.

  • It's not plenty of time. I've been burned for literally hundreds of dollars because an item wasn't shipped. Guess what, I waited 2 weeks to file a claim and bam, no funds to freeze because the seller was scamming (and it was a powerseller with good feedback) so I'm out my money when PayPal can't recover. If a seller sends me an email, I'll wait for a very long time. If not, I'm waiting 7 days. That's more than enough time to get a card in the mail and get it to me via first class mail. I've traded with quite a few guys on here, and never had to wait a week. And like I said, it's not the 7 days, it's the no communication at all for 7 days that was an issue. As a buyer, I feel you need to file as early as possible if you think there *might* be a chance you're getting scammed. That way funds can be frozen.

    Works both ways, I buy probably 5-10 items a month off of eBay and I sell 3-5 items. I don't expect anything more than I do.

    I understand your point, gstarling, but I still think filing a Pyapal claim 7 days after payment is made (when two of those days are not even business days) is premature and unfair to a seller who may have already shipped your item in the meantime. If a seller is intending to scam you, even 7 days is much longer than he needs to empty his Paypal account, so that analogy isn't accurate in this case.
