When a seller sends a graded card, but not the one pictured...

I won an auction on Ebay for a PSA 9 card I was looking for, but the one they sent was not the one pictured in the auction (different cert, not as well centered, and a bit of edge chipping). The auction did not state that a stock photo was being used.

So far, the seller's ignored my emails asking if he sent the card by mistake, and if could send the one I ended up with back for the one pictured in the auction.

If this seller continues to ignore me, and I file a claim, what's the precedent as to who Ebay/Paypall will side with?

    did you pay it with paypal?the old switch and bait trick,keep emialing him and driving him nuts, or you can get his phone # off there under request contact info and ask him what his major malfunction seems to be

    Hey Rich,

    Sorry to hear that happened. Here is what I know. You can file a complaint with Paypal for the item. You will have to say that the item recieved was not as described. Paypal will side with you if you can prove that it was sent back to the buyer. That being said you could run into trouble that both items are PSA 9 of the same card but i think you should be ok as it was not the item pictured.

    Anyway, that's what i know and hope it helps.

    The same thing happened to me today. Same grade, and seems equivalent comparing it to the auction picture, but different serial #. It just rubs me the wrong way when the seller states "see pictures below" in the auction, and then ships a different card.

    I have to confess I have done this a time or two. When I have 3 of the same card all graded the same grade on auction at the same time I have just mailed what was handy. The all looked about the same so I figured no big deal. Never got any bad press from the buyers.
  • I've thought about this, but have never actually mailed a duplicate.

    Try my best to match cert numbers.

    This can be a pain if you have several copies of the same card/identical grade.
