Sorta OT: Help with a Paypal claim...

So, I sold my old laptop on eBay. I put in the auction that there was a charging issue, that I didn't know specifically what the problem is, and that the item was being sold as is.

The winning bidder had a 98.3% feedback rating, with 9 negatives in the past 6 months. And of course his feedback was private.

He emailed me yesterday, saying "The DC port is messed up on this computer. What are you going to do about it?"

I referred him to the auction description, where it states SOLD AS IS.

He leaves a me negative, and files a Paypal claim. In the resolution options, it is listed that he "would accept" a $60 refund, and consider it resolved. His is email is laptop_parts or something like that, so I'm guessing that this is his scam, to buy it on the cheap, and then try to extort a discount, and sell the parts.

Does this guy really have a leg to stand on? I thought AS IS, was pretty self explanatory.

If Paypal sides with him, do I have an appeals option?

    I doubt he'll win since you acknowledged the defect in the listing.

    It is PayPal and you are the seller so you stand a good chance of being screwed.
  • If you accept Paypal there is no such thing as AS-IS. Offer him a full refund upon reciept of the same item back. Be sure when he returns it you open it in front of a postal employee such as the postmaster as this is the only protection you have if he pulls a switch on you. Do not even consider a partial refund.

    Let me guess you left him feedback first.. If you did you played right into his game.

    its a 50/50 flip up with paypal most of the times, but the the other post said,if you said as is in the listing, i dont see how they can side with him,take the neg and give him another one unless you already left a + image,AS IS is pretty clear to me- he'll prob get kicked off b4 then anyhow with that kind of pathetic feedback record,! go tell him to buy a new port lol- im always a little learry of anyone with a private feedback, usually they are a know it all or a troublemaker,in my experience anyways!there is not appeals on paypal disputes i believe, its pretty well in stone once they decide it,i would give him nothing refund wise but thats just me,how much did it go for on the auction?,thats what i would go on if i was you 60..00 or the whole sum of the auction,what the price diff between the two ?

  • Does not matter if Ebay boots him or not. Paypal is owned by Ebay, but they are 2 seperate entities. and the claim will stand regardless of if Ebay boots him or not.

    98.3 is not that pathetic. One of the biggest sellers on Ebay has an 89% FB rating If he has 60 FB that is just one neg. You can track down their feedback even if it is private, but can take a while.

    i thought everybody knew paypal was owned by ebay, they get you coming and going with fees,thats why ebay bought em! in this guys case, i would say his feedback is pathetic,thats why its private,lets let him tell us how many transactions this guy has to get 98.3?- 56- or 56,000 big difference

  • Feedback and stuff like that does not matter though to Paypal. There is no such thing as an AS-IS sale with Paypal. The buyer will be required to ship the item back with tracking when the tracking shows the seller has the item back Paypal will refund the buyer in full.

    I lost a case like this last year on an 200 dollar comic that was described accurately I said it did not have the coupon that makes this a 2000 dollar book. Buyer got it claimed it did not have the coupon. Paypal had him ship it back he shipped back a totally different book with DC and Paypal gave him his money back. That is why I said to open it in front of your postmaster if possible so they can immediatly update the DC and file any ossible charges right away.

    Never take Paypal for more than you can afford to lose. I am still betting the OP left the buyer feedback first and walked right into this scam.

    ouch, that sucks leisa,good idea about opening in front of postal employee!!i send out EVERYTHING with dellivery confirmation, so they cant pull the ol"wheres my item gig",that way when someone tries an dispute with me about not getting an item, the proof is already there,and i almost never lose because of the d.c. and or insurance, just depending on the $ involved in the situation! now they have the stupid chargeback thing on paypal to screw ya with too, i had on filed against me and it wasnt even for me, they made a mistake, it was for another person!the bidder told em and i lost anyways and had to pay their 10.00 scam for the chargeback,paypal is starting to suck,way more than when they 1st started

    You got that right. Also, I find it laughable when a seller states
    "not responsible for lost or uninsured items" and they take Paypal.

    The "As-is" might not mean anything to paypal, but the acknowledgement of there being a defect does. I've had a NAD complaint filed against me with paypal and they ruled in my favor because I could show that the description and scan showed the defects the scammer was complaining about.

    That just sucks about your laptop deal. I hope you win the case but from what others are saying it doesn't look good. I didn't know if you state 'sold as is' that you weren't covering your bases.

    One thing mentioned by others about sellers who state 'not responsible for uninsured items lost or damaged' and they pay via paypal. You guys are wrong on this one.

    I'm one of those sellers and just last week I had a buyer claim they didn't receive the item, even though USPS delivery confirmation showed it was delivered to their apartment. They filed a paypal claim on me and they lost. They decided not to purchase the optional insurance too. In the eyes of paypal, postal insurance doesn't matter, it's delivery and or signature confirmation with tracking that they go by. I think the buyer was trying to scam me but it didn't work because I mailed it with DC and purchased postage right thru paypal.

    So to those buyers out there thinking they can scam sellers, they'll lose every case if the seller mails their item with DC or sig. conf.

    In the eyes of paypal, postal insurance doesn't matter, it's delivery and or signature confirmation with tracking that they go by.

    This was what I was trying to convey without going into detail. 1) If a buyer pays with paypal, you use DC and it shows delivered, he said never received; seller will win because of the DC. 2) Buyer pays with paypal, you send with DC and it arrives damaged, buyer didn't pay for insurance; seller will most likely lose as buyer will claim item arrived "not as described".

    As with the example provided by SDavid, I like it. Glad it worked out for you, but those are very rare cases.

    P.S. I've bought a couple items where the sellers have used the Paypal postage printout with DC, and I've never received the items......the DC numbers just says the post office was electronically notified of you dropping it off....blah, blah, blah". Paypal refunded cos it never showed delivered. So this can be flawed too.

    pretty sure you will be OK as long as you do have DC. How it works the buyer will have to say the item arrived not as described and will have to show proof that the item was returned to you before Paypal will rule in their favour. So, you wil have to refund the payment but only after they can prove that they sent it back to you. Hope this helps.

    Do a search on Youtube for Paypal scams and you'll see how lousy the system is for honest sellers. Makes me think about accepting MO or Check only. In fact, I think there was a link on another thread about a guy who got totally screwed by paypal when he sold a computer on ebay and the buyer actually painted it but then didn't like it so he wanted to return it. The seller got screwed, of course, on that one, too.

    It's a shame that ebay is turning into Scamville and ebay doesn't care one bit about it.

    I would pull your money out of Paypal, just in case.

    That only works if you withdrew the $$ before the buyer filed his claim. At that point, Paypal will "freeze" your balance till the amtter is resolved. If there is no money in your account, you will wind up with a negative balance and any subsequent payment that you receive via Paypal will go towards that debit amount.

    Sorry I didn't reply... I was out of town for a beach weekend. Woohoo!

    Anyway.... Paypal did side with the (rhymes with poosh)bag.

    When I receive this thing back, what should I do? Open it at the post office? Take pictures.

    I am very concerned that he is just going to put another computer in there, or strip the lcd off of it or something of the sort....

    The more crap you hear about these scammers, the more sense it begins to make to accept Check or MO only.
