FYI beware stevenjackson39 he took my $400.00 and under bad circumstances

i hate to be writing this, i have had many great transactions on this board, but as some of you may know i have been trying to finish my 86 fleer basketball set and i have it down to 2 cards (barkley and jordan). i posted a couple of wanted to buy threads looking for the cards i needed, and i got a couple of the ones i needed, thank you all. i had one person say he had a jordan in psa 8 available for $400.00, since it was a decent price i started the transaction with stevenjackson39, of course he didn't have a scanner to send me a scan, i guess i should have known then and there that this wouldn't finish right. then he sent me a paypal account that was not active, thebattersboxonline@yahoo.com, and he gave me assurances that i would be able to get a money back guarentee if not satisfied. then he gave me a new paypal account, thebattersboxma@yahoo.com, i thought it was just a typo or something along those lines since they were very similar. i sent payment and he received it. then the run around starts, he has a couple of things going on he said he would get it out to me in a couple of days. then he needs my address again, all the while i'm continously pm'ing him to keep up to date. then he says he's on his way to the post office to mail it but nothing!! then i get this pm'd to me

fred- unfortunately ive been dealing with some personal things the last few days- I learned Wed. am that a close riend was killed in active duty in Iraq. He was a highschool friend whom was there less than 2 months when he was shot dead on a routine check. I have been unable to get anything together but I appreciate your patience and apoligize for the delay. I have a memorial service to attend Monday and the burial Tues but I should be able to get the jordan psa 8 rc card to you this week. Again I apoligize for the delay

so i give him a few days because of his loss and i could appreciate that and the sitution, in fact i felt very badly for him, should i have???

i then get this
just wanted to keep you abreast of the situation and I will be mailing it no later than Thurs- Im getting ready to head to the funeral services in another state but will hopefully be back by WEd or thurs...thanks for the thoughts for our fallen hero

nothing for 2 weeks, then i see a thread on the boards regading this guy not paying for a fantasy baseball league he was supposed to get into with board members. apparently his email is seanzach39@yahoo.com. apparently months before. i told the gentleman who's thread it was i would post the results of the dispute

no responses at all....after a month and 30 pm back and forth, mostly to him, i started a paypal dispute and receive back .10 after it being found in my favor.
now i'm out $400.00 and worse yet this guy uses the war in Iraq and one of his friends getting killed as an excuse. now i do not know whether this person was actually killed, i hope not, but ieven f so why not complete the transaction or respond to my or paypals emails and pm's after all this time?????

i find it dishearting that this happened and under these circumstances. i don't think i have any other avenue for recovery but i wanted to at least let everyone here know so it doesn't happen again.

i live and learn i guess.

    If I were a crook, I wouldn't develop a dialogue with the target. I'd take the dough and get outta Dodge. Not sure, but he sounds like a weird guy. On the other hand, I don't buy the soldier story, Not saying that he doesn't know a war victim. Just that I recently lost three friends in a span of a bit over two weeks, but was able to mail out all my orders on time. Tell him, "The card was for an old friend that is heading off to war and he always wanted that card, we'd like to get it to him before he ships out." IMO, He's playing on your emotions.

    Got an address?.. Drop a dime to his local PD

    Many online boards attract riff-raff. Hope you get retribution.

    Did you pay with a credit card through Paypal? If so, take it up with your credit card company. I have done this a time or two and have received complete payment back from my credit card.

    You need to go to the police department in your own home town and explain what happened. They will likely tell you to contact the PD in his hometown, but of course they can do that FOR YOU, and it will get the other PD's attention. They can contact Paypal and obtain his address. Keep in mind that if the police can convince you it's a civil matter they will, but press the issue. Theft is a crime, whether it's confusing, poses jurisdictional issues, and requires them to work or not.

    You should receive a prompt refund on your chargeback request.

    I would also call a live person at PayPal and tell them that yet
    ANOTHER thief has been allowed to use PP to rip-off consumers.

    He seems like he might be this guy. If he is, Buffalo isn't that far from me and I'm sure a few other members here. The Buffalo cops are pretty helpful.

    On your paypal receipt it usually gives a name. At least gives you something to start with, see if there is anybody with that name in buffalo. A credit card chargeback is great advice, maybe paypal will be more interested in helping you when it's THEIR money at risk!

    definately do a charge back on your credit card and was mentioned and file charges at your local pd. as basestealer mentioned, the police may try to convince you that its a civil matter, it is not. its clearly fraud. talk to the chief if you have to. nowadays local pds are getting more involved with the internet fraud thing because they have to with its incredible growth. forget feeling bad for this loser, the whole thing was to deceive you.

    winpitcher is dead on that one thing has nothing to do with the other. if this deadbeats story was true, the amount of time it took him to email you twice the excuse, he could have send you the paypal refund, since he cant ship the card now. maybe you are overlooking the obvious--maybe the card was in iraq and he is waiting for his friend's personal effects? yea, thats it. -------excuses are like heinie holes--everybody has one.

    I'm sorry to hear about that Baseballfan.
    I actually bought some rack packs from volver and waited and waited and waited until they finally came after about a month of waiting. I actually noticed that he stopped posting about a week after i bought the packs and got scared. Im just happy that i received them ok though. Of course, if he wouldve ripped me off, i wouldve been out $10 and not $400. Again, I'm sorry for your bad luck and I know you are truly a great trader and collector considering the few deals we have done. Good luck getting your money back!

    If you came to see me and the guy was not in our town, I'd tell you to contact HIS PD as they are the only jurisdiction with Venue. Your PD is under no obligation to do "favors" and I highly doubt that his PD will be willing to jump thru all of the necessary hoops (subpoena's and etc) to get someone's info on something that they will more than likely call a CIVIL MATTER. You will be very lucky if it's a small department and you might get an officer to go knock on his door and have a chat with him....but his being charged is just not much of a reality.

    File a complaint with Paypal. If that fails, file it with your CC. If all of that fails, sue him civilly in your court.

    No I do not believe that they are the same. It is just Volver told that he was having issues with Paypal and could not send me my money until he got it straighten out, that was at least three weeks ago. I gave him a refund on a card he said had not been received by him, it had been about a week or so, so I refunded him the money. He gets the card within the next day or two. I wait a day or so to see if he would send me the money, then the paypal story, then no responses.image

    The price should have been a tip off. $400 is far too cheap for any legit PSA 8 Jordan RC.

    I don't wish to be judgmental and I hope everything works out okay for the buyer, but just strictly my interpretion of the situation based on the "story" - it sure appears to me that the seller initially was trying to stall the buyer until the 45 day time period expired when it would have thereby been too late to file a PayPal claim. That didn't work so now we'll see what happens. Just my opinion - hope I'm incorrect about that.

    chargeback - based on a fraud complaint - for a VERY
    long time.

    180-days is easy; more than 1-year is possible.

    I had a discussion with my credit card processor a few months ago, and they told me a buyer can file a claim for up to two years, for any reason.

  • Yeh, you got scammed. It has happenned to me before. I do not advertise what I need anymore, scammers can smell when you are desperate to finish a set. I prefer to search out the item myself. I usually ignore emails from strangers offering me an item I need in my registry set.

    Its a tough call actually, I have been fortunate in posting in the BST forum. A few months ago I posted looking for a card and a guy from Texas emailed me offering me the card, he doesnt post on the forums here but I took the gamble and sent him $380. The card arrived safe and sound about a week after I sent the money. Your taking a chance IMO but it can be a good thing more often than not.

    That was pretty brave. I'm pretty trusting of most guys here, but if I were approached by someone who doesn't post here, I'd probably be a bit nervous to pull the trigger. Especially for $380. I guess you just have bigger marbles or a bigger checkbook than I. (Probably both) image

    Although my recent story has not cost me 400 dollars (I am only out 10 dollars), I do get fed up with ebay and paypal about trying to get back my money, and the sellers that will give excuses for taking your money but not giving you the item you purchased.

    I bought a card at the end of March. I paid quickly. The guy does not respond. He later responds saying that he had been in the hospital. Says he would send me the card. this goes on for three or four email back-and-forths, where he says he was in the hospital again, or some other excuse. I finally give him an ultimatum two weeks ago, which he ignored. So over 60 days later I leave him negative feedback, file a complaint with eBay and Paypal (which both say it is too late to do so), and call my credit card company which says that it is too late (past 60 days).

    I too let the emotional pool keep me from filing a fraud complaint earlier.

    I will call the credit card company back, based on what storm888 and stevek.

    and I have no qualms about stating his name: craig ginter, ebay id effex-seven. his ebay rating was near perfect when I won the auction. since then he has done this to two others.

    he had contacted me a few times trying to work out a payback and now nothing for over a week again. first he said it would take 4-5 days to put money in his bank account to pay me back though paypal, and he asked if i wanted to complete my credit card investigation, i told him to do the bank transfer since the 4-5 days, which i think it's a little quicker then that, would be faster then the credit card co.
    still nothing, i've sent him several emails for updates and pm but nothing
    i'll keep everyone posted.

    in my opinion I would get on this ASAP before he moves and is much tougher to track down!

    i have a dispute started with the credit card company already. if i get no where with that i will proceed to the police, i used to be the city manager here at home and was ultimately in charge of the police department, so i have some friends there still and will move forward with that end of it.

    then you'll know that your police can't do anything and you'll be lucky if you can get his to do anything also unless they are a small, very bored department.

  • Your polic will not have any authority over this case, you would have to contact his local police department. Sad thing is most will look the other way on this matter, unless they are as stated a small bored department and even then most that will happen is they may go talk to him and advise him to fix it, but otherwise there is little they will do.
  • im sorry to hear that your situation hasnt been resolved.

    I was screwed by this guy as well, but to a lesser degree. I recruited him to an ncaa tournament pool and a baseball fantasy league this past year. I require a fee to enter both leagues (both in yahoo). He promised me several times that he will pay and be active in both leagues, but never did either. Thankfully the leagues are free to setup, so i technically didnt lose any money (the fees are used for a prize for the winners at the end). But, i did waste a valuable spot on these leagues...both of which i only try to recruit people i know.

    His name is sean nicotera. Do a google search on him and you'll find out he's a big time scammer.
