Mickey Mantle business card...

Hey guys,

I just thought I would share this with you. I think I am abandoning the Honus T206 business card, in favor of the Mickey Mantle Topps '52 issue. I was mazed to see how many people didn't even know who Honus was, let alone the card. I figure that at least with the Commerce Comet, they SHOULD know the name. Right?? Argh...

Anyways, sorry the image is a little washed out...

    Best be very careful with that - I doubt very much if you could use Mantle's image on a profit venture without permission from his family. You are staring at a sure-loss lawsuit with punitive damages and paying lots of lawyer fees.

    A friend of mine has a towing company : Hulk Towing :
    On his trucks he had painted images of The Incredible Hulk , well The comic boook company was looking to take him to court , what wound up happening was he had to put a beard on the Hulk and everything turned out OK .

    The black beard version looks like Osama bin Mantle. That ain't right... ain't right at all.

    Following up on Steve K's comment, what do others think about people who are churning out unlicensed / unauthorized items of players. Like HERE for example. And HERE is another person who makes light switch cover plates as well.

    Something about this just rubs me the wrong way, I won't buy them, and I have to think they could get in hot water for using these images / likenesses without permission. I can only imagine no one reports them perhaps?

    I have certainly taken into account the possible issues I may run into by using Mantle's image on my card. As it stands, it's something that I am going over with my lawyers. Of course, the area is rather grey, as there is the whole freedom of speech issue; but of course the other side argues that I would be capitalizing off of the likeness.

    As it stands, thankfully I am allowed to sell original works of art - as they're my original interpretations, no matter who or what they depict. It's once I start getting involved with the mass marketing of these things that I could get into some serious trouble.

    Either way, the worst thing that could happen at first (I imagine) would be a cease and desist order. And of course, that's only if the wrong person sees the image.

    As long as I'm not in court like good ol' Rick Rush was a couple of years back...

    Just be careful because you don't want the Mantle estate coming after you...
    So basically my kid won't be able to go to college, but at least I'll have a set where the three most expensive cards are of a player I despise ~ CDsNuts

    Yes I would have to believe that you could sell your artwork and perhaps limited prints of it without permission from the Mantle estate although I'm not 100% sure about that. But as far as the other thing, in my opinion that pretty cut and dried...like you imply...they might not bother with a "small-fry" but if the business grew big, you can be sure that you'll get "the letter" from them demanding their cut of your profits or something such as that. I think you're much better off just drawing an original picture of a ballplayer from your imagination, and using that.

    I have no idea with regards to the legality of such things, but from a moral standpoint, I do not see an issue with Graig using this image. My pet peeve is when people directly PROFIT from use of such image. It is not like Graig is selling these business cards like in my previous post examples. I know we have a few lawyers on the boards here, can anyone lend some insight as to the law's position on the matter?
