Difficult E-bayer...........

I won a card on Apr 22nd, Granted it wasnt but a $10 card,but, I would still like to get it.
I e-mailed the seller 14 days after the sale and asked him about the card. His response was that he shipped it long ago, Let him know when it arrives.
So I waited another week,no Card.
I sent another E-mail asking if he had a confirmation # or something to track it by, And if the card hasnt arrived by Monday that i would like him to refund the purchase.
He sends me an E-mail today that says it is not his policy to offer refunds until after 30 days and to give him until Weds the 16th.
IS this guy stalling? Can you still file a item not received after 30 days with E-bay ?
Should I just be more patient ?

    No, don't wait any longer. I was a nice guy once but then realized you only get stepped on.

    The USPS is pretty conviced that items are not lost
    until 30-days have passed.

    You can file an EBAY/PayPal claim within a 45-day window.
    A credit-card claim can be made many months out.

    I would comply with the seller's request. This will make
    you appear "reasonable" if/when you have to file a claim.

    I have waited 30+days, in the past; the items finally arrived.

    Be patient but don't go beyond the 45-day window. I am just about up to 30 days waiting for a thing and worse, the seller's replied not once to any of my emails (sent 3 total.) Once I hit 30 days I'm doing a PayPal chargeback - freakin' sick of this crud, I am. image

    you are being more than patient on this. the seller's policy has nothing to do with it. it's paypal's policy that counts. i'd file with paypal now. once the seller at least shows d/c number to paypal they will wait 30 days for it to show up. i'd start the process now.

    I doubt the seller even put Dc# on a $10 card. I will wait until Weds, Then I file item not received.

    Last month a buyer of mine claimed a card never arrived to him. It had been 2 weeks since i mailed it. I asked him to wait 30 days and if the card did not arrive by then i'd refund his dough. On day 31 he emailed me and still claimed the card did not arrive. I refunded him his pirchase price and shipping.

    I think the guy is being very reasonable. 30 days is standard in my opinion.

    by the way the card i was talking about was 39.99 + 3.00 shipping.

    I asked the guy to re pay me if the card ever shows up.

    he has lots of feedback and has bought from me before.


    Sometimes you just have to be patient.

    I guess I'm pizzy since I had the 2 months - no delivery or email guy (did leave that thief a well-deserved neg, but like he cares - he kept my $30) and now this genius, 30 days on a $100 item and nothing - but what galls me is not ONE response to emails, sent both through eBay and my personal account.

    Damn right I'm getting my $100 back from this worm - without delay, as soon as it hits 30 days - this Tuesday, I believe. I've informed him as much with another email - and I don't expect he'll respond...

    EBAY commerce has now reached the point
    where sellers MUST use Delivery Confirmation
    on everything, and USPS insurance on most items.

    Agreed, storm - as a buyer for the most part I'd like to have the same! A number to have and insurance just in case. Now, if only my seller would RESPOND to an email... image

    As long as he is communicating with you and responding to your e-mails (and it sounds like he is), I'd also wait the 30 days before either filing a claim or getting a refund. As storm pointed out, waiting 30 days makes you look more than reasonable, so if the card doesn't show up by Day 31, there should be no reason why the seller won't grant your request for a refund, and if he doesn't, you're still well within the 45-day Paypal window.

    Never, ever ship anything out without Delivery Confirmation, regardless if it's ebay or not. It's not for the buyer but for you, as the seller. 50- or 60 cents is a small investment to save you grief.

    I am ok with delayed delivery as long as I am able to communicate with the seller.I may be one of the lucky guys as I have had no problems with a seller from whom I did not recieve a card from.I have either recieved a refund or another card.I usually give it 2 weeks before I notify a seller of non delivery and 30 days before I ask for a resolution.I have had a card take almost 2 months after post mark date and sent the card back as he had sent me a simalar replacement card.
