Fraud Recovery - What Can I Do?

Recently I was defrauded by a seller on Ebay.

Although I am out only $38.59, I am using this opportunity to learn more about what a person can do after they have been victimized.

Has anyone experienced fraud and done something beyond just taking the loss and saying, I'll be more careful next time?

Any (legal) ideas are appreciated.

    File a complaint with the Post office even though they may wish to do bodily harm to you over 30.00.

    File a complaint with HIS Police Department if they will let you. They will more than likely tell you it's a civil matter. Ask them if they've had any other similar complaints on him? Ask them if they'll at least go knock on his door and speak with him when they have time but explain that he may have done this to quite a few people.

    File a civil suit against him in YOUR local court.

    That'll keep you occupied for a while.image

    The guy is probably up and going on a new ID by now.

    I would just forget about it. The principal is gone, and
    there is no principle to enforce. It is not worth the stress
    for $40.00.

    NEVER buy anything on EBAY from a stranger, unless you
    use PayPal, funded with a credit card.

    Don't worry about me. I'll be fine. I'm going to make money in the end by writing my experience up (I do freelance writing on the side).

    What I want to know is: What can you do - legally and at minimal cost.

    If you count your time's value at ZERO, you can file
    a small claims action in your town; if you live close
    to the culprit, you can file in his jurisdiction.

    Once the complaint is served, the guy will not show up
    and you will get a default judgment. You can then file
    it with the bureau of conveyances, and it will attach to
    his property. You cannot foreclose on his house for
    $40.00 plus court-costs, but the lien will be there if
    he goes to refinance or sell.

    It is a waste of your valuable time and mental energy.

    I suspect Jskirwin is of the same attitude as me.

    If someone hoses me, no matter the amount, I will spend multiples of that to exact justice on them.

    I fear the world is fresh out of justice.

    Sometimes, revenge is for sale; and, that is a good thing,
    if it is not too expensive and time consuming.

    It does feel good to file a lawsuit, though. It seldom results
    in recovered monies, but it feels good.

    My friend just got took for close to $1000. PayPal said they can only help up to $200 of the purchase. He banks with Wells Fargo
    and lucky has buyers protection and Wells Fargo has put a reversal towards PayPal for the transaction. I hope he gets his money
    back. Then PayPal will have to try to get the money back from the scammer. My friend bought a new laptop. Guy had a small
    rating of 16, but 100%. He paid and the transaction went thru, and he thought everything was fine. 3 days later still now word
    from the guy about when he shipped or anything. So I look at the auction, he just registered on eBay, and all the 16 feedback are
    from different people from items he had bought, and they were all auctions for items less then $1. The email address he listed with
    eBay was some place like Yahoo with millions of users.

    Me too. Since it's a private company, those statistics may be impossible to find. But I'm looking.


    As for why I'm pursuing this.

    First, I don't like being taken - or bullied - by anyone.

    Second, I'm working on an article about my experience that can warn others about fraud, and if they still get ripped off, what they can do about it.

    best of luck. I would feel the same as you to keep the scumbag from continuing on with his scams.

    Is there anyway we can create a network around the country to help with any legal actions if these scumbags are in our areas to help out others?
