Okay this is crazy.......What do I do now?--UPDATE

The winning bidder from the original auction in my other thread (Would it be possible to round up all non-paying.....) just sent payment through paypal for the framed jersey. It took him 17 days and a non-paying bidder dispute but he sent payment last night.

He said he had a death in the family and he was out of town. I know its a classic ebay excuse but I kinda believe him. Upon winning the auction I received a few emails from him basically stating how happy he was to have won. Then he just disappeared until last night.

The problem is, I relisted the item and it already sold to someone else. I do still have the jersey as I have not shipped it yet.

The original auction winner paid via paypal $254.00 and change last night

The second auction winner has not sent payment yet but the jersey sold for only $75.00. I would be a fool not to send it to the original auction winner.

So one jersey, two winners.

What do I do?

    be honest about the events that took place with the first bidder with the second winner and hopefully they will let you out of the deal.
  • Simple.

    Contact the $75 winner and explain the situation. Agree for him to do a "non-transaction" through eBay so you get your selling fees back. If he is bitcy about it, send him $25 "for his trouble."

    Sounds like either person is going to be upset. I would just try to explain it to the 2nd person...if he hasn't paid it would be even better, but I'm sure refunding would be easy.

    Or if you have strict payment and shipping terms you might want to stick to them.

    I'm very flexible when it comes to how long it takes to get paid especially from bidders with good feedback so I wait longer to relist than most.

    I would sell to the first guy and try to explain to the 2nd guy if you feel the 1st guy did nothing wrong.

  • You followed proper procedure with the first bidder who did not pay in time. As a result you relisted the item and the second buyer purchased it fair and square for a lower price. You need to:

    Notify the first bidder that the item was resold due to his non-payment

    Ship the item to the second buyer and suck up the loss.

  • I think your mistake was not closing the non-paying bidder dispute before listing it a second time. If you did, you would have wiped your hands clean of the first transaction and received the FVF for the original auction.

    You risk neg feedback in this situation.

    Damage control: communicate with both by phone to do this fast - explain to the second winner what happened. Get permission from the first winner that you can forward his email to the second one to show that you're not lying just in case the second winner doesn't seem to believe you. Explain on the phone you screwed up to the second winner for not closing the dispute for the first one. Show the emails of the dispute (if you can) and the auction number of the first auction. Be apologetic. Let this buyer know you want to honor the first one's payment because he had a death in the family. He can't dispute that. You have a better advantage on the phone doing this than by email. They'll appreciate that you called them and explained everything. They won't be happy. Send them an ebay certificate of $25 or something as stated in the other post and send me $25 for this advice. image Then you're done.

    Another thing I failed to mention was the fact, I had no payment terms listed in the auction as to when payment should be received.

    I did relist the item after waiting a week + because I thought it was a long enough period of time to make payment through paypal. Coupled with the fact that I was not getting any replys via email helped in my decision to relist it.

    I would ship to the first buyer.

    I would contact the second-buyer: "I am terribly
    sorry to cause you trouble, but this item was
    listed in error. It was previously sold on x-x-07;
    item number xxxxxxxxx. To help make up for the
    error caused by me and TurboLister, please accept
    a $15.00 gift certficate on any item I list in 2007.
    No minimum purchase required. Again, sorry to
    disappoint you."

    Forget about trying to collect the FVF on the second
    sale.

    Yeah, I really dont sell too much. I buy way more than I sell. I was just trying to sell this thing to help pay for some card purchases image

    Why not just list it a third time. Maybe buyer one and buyer two will get into a bidding war!

    Good point. The dog can pee on stuff though. Whatever you decide to go with, pee should be involved.

    Give the second bidder $20- for his troubles, say it was a relisted item and that the first bidder finally paid and you would prefer to honor that bid/auction.

    I do not believe you filed too quickly, but I do believe you should have waited until the dispute was closed before relisting, you have to wait to get your original listing fees back. I think paying within seven days is pretty standard etiquette on ebay. The honorable thing for you to do is sell this to the second bidder, even though it sucks.

    Just to let you guys know, everything worked out great. The orginal winner of the first auction will be getting the jersey.

    The second auction winner image was a little bit upset but we worked it out. Turns out she is a huge Emmitt Smith fan but she is a also an Eagles fan???

    I dont know how that happened image

    I sent her some Emmitt rc's, some early years inserts and an autographed card to help make up for the mess.

    Nice racket you got going. Auction an item twice and take the highest bidder and then send the loser excess inventory.

    LOL! Just having some fun with you. But I wonder if several scammers have ever tried this method.
