Question About Dispute

So I find a set of Series 1 Garbage Pail Kids on Craigslist. The description indicates that this is a very rare set of cards, not the stickers that were made prior to the stickers being released in 1985. I had never heard of this, so I thought maybe it was some cool variation. He indicates that they are worth in excess of $300, but really needs the money and is selling them for $110.

We e-mail back and forth a few times, he tells me he got these from a dealer in Ohio, they are mint and super rare US version. He says he has some medical issues and is selling all his collections to get money, that is why he is selling for less than book.

So I pay him through Paypal, cards come yesterday and they are the UK version worth $25.

I email the guy and tell him these are not rare, just UK version, so I give him a few options, refund me minus $25 or I can just return them.

He emails me and tells me the dealer told him they were a rare US version and he paid $200 for them, so he can only refund $30 because he is losing money.

I respond and tell him I am sorry he was mislead but I cannot pay $80 for $25 worth of cards. So I offer that he can refund $70 and I will eat the $10 bucks.

He responds with an email calling me an A**hole. Then offers me a $50 refund, costing me $60 for the cards. He then tells me that he has some medical condition and really needs the money to pay a bill and already had this set aside.

What should I do? I do not believe he intentionally misrepresented them to me, but I feel bad if the guy has some medical condition and is broke. The $20 will not change my life, but since he called me an A**hole I am not inclined to give him a break.

What do you guys think?

    If you have any coverage through PayPal, your Credit Card
    issuer, or CL, you should use that coverage to seek a full
    refund.

    The seller is a scamster. $100 will buy him two-aspirin and
    a band-aid in any hospital in America. When sellers start
    telling you about "medical issues," it is ALWAYS wise to run
    away really fast.

    Go to the PP site and see what kind of dispute/claim scheme
    is available for off-EBAY transactions.

    My sentiments too.

    The guy waived all sympathy in my head by calling you out.

    If ya can - see if paypal will take the money back and return his cards.

    Everyone has a "story" these days and I want to believe them - but the "story" got trumped by calling you out IMO.

    Wanted to makesure I did the right thing.

    I filed a claim with Paypal and will with my bank if I have to.

    i agree with storm. i think each aspirin is $40 and the band aide is $20. so $100 sounds correct.

    i doesnt make any difference how much that seller paid for them or what the previous seller said to that guy. the facts are the current seller misrepresented the items and you should get a full refund.
  • you can try paypal but I don't believe paypal offers any buyer protection unless it's an ebay sale and paypal is used. i think your best bet is your credit card.

    This guy has medical issues like I'll be sending in my mint 52 Mantle to PSA for grading next week. He is a scammer and trying to screw you. File a fraud claim through Paypal, and if they don't do anything (they may not because it's a dispute about goods not non-delivery, and it's not covered by ebay buyer protection), then try filing a claim with your CC company if you paid that way through Paypal. I wish you luck in getting your $$ back. Moral to this story is that when a deal sounds "too good to be true" it usually is. At least it was only $100 this time, a valuable lesson learned.
