Ebay sales tax scam what do you think.

I think I ran into an new scam for sellers to make more money. I won an 800 wax box the seller claims i need to pay 8.75% ca sales tax. I emailed him with my CA resale license number. He resoponds saying he does not have time to fill out paperwork for that and I must pay almost 68 dollars in sales tax. Better yet he wants payments made out to him not a buisness name. Now Im not a genius but this sounds like a seller scaming a few extra bucks on sales tax I bet hes not paying to the state. If hes legit it takes about 2 seconds when filling out his quarterly taxes to right down my resale number and the purchase. Plus Ive never had a buyer collecting sales tax refuse to let me use my resale license chit thats what its for.

Explain that he refused your cert and had you make the check to
him privately. Include copies of emails. Ask them to get you a
refund or credit. "

Or.............
First, you could simply "promise" the seller that you were going to
do that, IF he refuses your certificate.
If he still will not budge, I would follow through with the "promise."
It is illegal for him to charge a buyer tax if the buyer can furnish a CA resale number. My guess is that he, like many others on ebay, is scamming you for the tax and not reporting it anyway. You are following the law. He is the one in the wrong. Like others said here, I'd stand my ground and tell him that you'll be reporting him to the IRS if he wants to play games with you. Frankly, at this point, I'd be reluctant as a buyer to send this guy any money at all.

Inform him that you are turning these e-mails over to Ebay for Internet Fraud. Also ask him for his business license #.
You can file your complaint Here if you want and name and email are optional. I would love to see the guy's face when somebody walks in and asks to see all of his records for ebay sales and tax collected and submitted!
That would be equivalent to me going into a Bob's Store and buying sports cards and asking them to take my tax number.
Alot of dealers just don't want to have to keep others numbers on file.....they have to have a copy of your certificate on hand in order to let you be exempt. Then there's the flip side of the coin...who exactly do you trust with a copy of your tax info??
I don't think the guys being unreasonable...and he is correct...you should have asked 1st and not just assumed.

There is truth/merit to that position.
If the seller is a legit retailer, there is no way he can be forced
to accept an exemption-cert if he chooses not to.
My concern rests more with the seller collecting the tax and not
sending it to the state. That is a very common practice among
corrupt sellers; online and off-line.
It appears that threats will not gain results here. You might
just have to pay and move on, or not pay and move on.
The tax paid to him would be deductible in some fashion, both
on State and Federal returns.
I think a lot of us would like to know so we can avoid him.
