Check this out, advice needed

Last week I won 21 psa cards for my Emmitt set from one seller. I received the cards earlier this week and one of the cards was wrong. I was sent someone elses card and they were sent mine. I emailed the seller and we spoke via email and phone. He said he was going to check it out and get back to me.

In the meantime I researched the sellers sales and found the card that I was sent by mistake. The buyer that won it is "jeremy05football" . He looks like a real winner with a 96. something feedback rating in only 61 transactions. So, I emailed him to let him know that I received his card and he was going to get mine. I told him we will exchange addesses and just send the cards to each other to fix the problem.

He emailed back within minutes telling me he did not receive anything yet. Today I contacted the seller and asked him to check his signature confirmation number for this sale. He got back to me and said it was delivered.

So this guy that got my card is now ignoring my emails. The reason, Im pretty sure, is that my card that he was sent is worth much more than the one he won and was sent to me.

So, short of getting this guys address and paying him a visit image ( he leaves in Florida to ) what should I do? Isnt that some type of fraud? I paid for something but he is trying to keep it. Its not right thats for sure.

thanks
Matt

MATT - A delivery confirmation doesn't always mean he rec'd it, it could mean that his post office rec'd
it and logged it in. Perhaps he'll get it in a day or 2 and does the proper thing and returns the cards that
    aren't his...jay
  • I think you should just deal with the seller, ask for a refund and if he gets your cards back tell him to contact you or relist them.

Thanks Jay.Sorry but I gave the wrong info. I meant to say the card had to be signed for making it sig confirmation. I will go edit the original post. So with sig confirmation that means it was delivered if signed for right?

It's certainly worth a shot to try to get some cooperation from the other buyer, but I'd say the seller bears the brunt of responsibility in this case. He's the one who should be working to get you the card you purchased. If he can't do that in a reasonable amount of time, he should refund your money.

  • It is probably not what you want to hear but I agree with Chris. Since the other buyer is not friendly you need to go through the seller. Plus the other buyer could lie and then he would have both cards. Since the seller knows you have "a" card you will not get a refund if you have nothing to send back. Go through the seller and if he cannot get your card send what you have back for a refund or a partial refund if you kind of like the card you were sent. I wish you the best of luck.
Always looking for interesting Don Mattingly and New York Yankees related items.

Thanks guys! The seller has offered me a refund but I told him I would rather have the card. I told him lets see what happens and the refund would be the last option. He is a good seller, it just bothers me that the other buyer would even think of "stealing" my card. I have been waiting for the card for a while. Its worth 4.5 on the registry and numbered to 1500, so it is a good card to have. Its the only 10 which makes me even more upset.
  • Hey Matt - check out my new sig line!! imageimageimageimageimage
