Very simple scenerio - opinions please!!

Item sells on ebay. Seller receives buyer's check, waits for it to clear, sends item, buyer doesn't receive item. What is the proper resolution?

Unimportant stuff:
Paypal wasn't offered.
Insurance or delivery confirmation not purchased by anybody.
Relatively low dollar transaction (less than 20 bucks).
Shipping & handling = $1.84

    In every other venue than Ebay baseball card sales the seller would be compelled to refund. The only circumstance that I would NOT issue a refund is if reading the buyers history they had other instances of "not receiving items."

    I recently had a 1st Class Parcel take 16 days for Minneapolis to Chicago.

  • I had similar problem. Guy never got what I sent. I kept insisting I sent it. One month to the day from when I sent it he got it. It was postmarked a month back. Or maybe that mailcarrier I read about recently who was keeping mail at his house and was not discovered until he died has it !!

  • If I was the Seller, I would offer a full refund. In most mail order/interent based sales, the failure to receive an item would warrant a full refund. I think eBay has changed the way some people do business because there is a feeling that the responsibility shifts to the buyer if the buyer didn't take necessary precautions to safeguard the delivery. I do not agree with that business model. With that said, I have noticed that several items that I have bought on and off eBay have taken 2 to 3 weeks to be delivered by USPS. I had one card take 5 weeks to get to me. If the time frame in your example is less then 3 weeks, I would tell the buyer that I will provide a full refund if the buyer hasn't received the card in three weeks.

    Seller has resposibility to deliver the item. Seller did not so he should refund purchase price.
  • Buyer is responsbile for buying insurance.

    Its so funny how for $1.50, you can guarantee your item arrives. Add $1 per $100.

  • under Ebay rules..buyer MUST offer compensation. You have to guarantee delivery.

    In the real world..I'm one who does not agree with this theory..as I have no control over the USPS and can't GUARANTEE anything that they do.

    With that said...if I'm buying something cheap..I always ask for a delivery confirmation to be added...if it's insured under $50..I still ask...over that signature will be given at delivery.
    When I'm selling...I have added the DC into my S&H fees and now add it to everything...

    It's a catch 22, if you were the buyer...you'd want a refund...as you are guaranteed delivery. As a seller, you've got a gun to your head to guarnatee something that is out of your hands.

    It's just too gray and area..for both sides. 50% feel that buyers should pay for extra services ( DC's or insurance)..that if you don't buy it...you're out of luck...50% feel that the seller is obligated to pay for it either way..to protect both sides and any recourse against themeselves.

    Simplest rule...C.Y.A. whether you're either side of the fence.

    buyer did his part by getting payment to seller. It's the sellers responsibility to get the item to the buyer.
    Whether or not the buyer bought insurance is irrelevant- insurance protects the seller, since it's up to him to get the deliver the product.

    As you know I don't sell on ebay and don't do a ton of buying either.

    But, the unimportant stuff begs the issue with questions:

    1. Why wasn't paypal offered?
    2. In the interest of customer service - shouldn't a seller strongly suggest buyers buy insurance or let them know the seller will not be responsible for the PO or potential theft after the PO deliverrs?
    3. Shouldn't a seller always buy confirmation?

    And last, I think a seller, in the interest of developing a good reputation of service, may want to contact the buyer on a small item and strike a deal. That is, let them know that you will send them another or refund they're money but in the future - it is highly recommended they purchase insurance.

    My general feeling? I don't buy from people who don't offer paypal unless I know them and I have to be totally comfortable with their terms for sale - i.e. ship/handling, insurance, packing etc.

  • As an aside to the sellers on the boards, do you advertise in your auctions that you send your packages with Delivery Confirmation? I would think you could ward off most of the potential scammer buyers by simply saying this in your ad.

    I note the shipping price and that it is priority mail with insurance. If they pay via pay pal I include delivery confirmation, but if not I don't since I think it's a waste and doesn't protect anyone, unlike insurance.

  • A seller should always use delivery confirmation at the very least to be able to prove the item was sent.
    On all items the buyer should have the option to buy or not buy insurance, this should take care of any problems if the buyer doesn't receive the item. If a buyer chooses to not insure and the seller has proof the item was sent then why should the seller refund money? Insurance seems to be the key.
    Advertising that del. confirmation is included in the shipping charge would I'm sure make a buyer feel more at ease, and if the buyer doesn't want to take any chances they should insure. I agree with what was said in the above post by Stone193, he makes some good points.

    I'd like to offer a proactive answer, but the way I'd handle this would probably be like the way I handle everything else-- forget about it, and let the situation fester, until things finally reached the point where I had to deal with it.
