How long do I wait?

I purchased a negative from an Ebayer on September 29th. I paid with Paypal echeck and it cleared on October 4th. Before I bought it, I pm'd the person and asked if I paid extra if they would ship Priority Mail. They said sure, just include the extra money, which I did for Priority Mail, DC and insurance ($75 total for the item and shipping).

I PM'd them again on the 13th or 14th with a polite pm asking for the status and DC#. I have yet to hear back or get the negative.


How long should I wait before PM'ing them again? They have listed another 8 items recently so I know they are on Ebay. And others who won auctions on the same day as me from the same seller have the items already and have left feedback. This seller lives in NY and I live in Maine and the seller has 100% feedback.


Am I being too impatient expecting an item within a couple of weeks?

  • Sorry for the bad post. I have the same dilema. Paid via paypal on 10/4.
    No word on my item. I sent a PM 5 days ago that went unanswered. Sent another just asking if they sent the item. Unanswered.

    I'm anxious to get others opinions.

    No, both sellers in the above examples should, at the very least, email the tracking #'s ASAP. Not knowing who they are, I would say that they may be hiding the fact that they didn't ship when they said they would or they didn't put the extra services that they claimed to.

    This is of course if they haven't been impacted by a weather event such as the Buffalo snow storm or the Hawaii earthquake, but these happened recently and your items should have been on the way before those events in any case.

    At the very least you guys are on the receiving end of poor customer service. You can request their phone # from ebay through the "contact the seller" link on your item page. Hope it is just a misunderstanding and you guys get your stuff soon and safely.

    No way! If you payed extra for priority, it should have been there a week or more ago. It only takes 3 to 4 days for me to send my psa subs from Fl to Cal. So from NY to ME it should only take a day or two. I understand that the seller most likely did not ship it the same day but paying extra for priority the seller should have shipped it a day or two after the acution ended. If he didnt then whats the point of paying extra for priority?

    I would email them right now.

    I purchsed this negative two weeks ago and paid extra for Priority Mail, DC and insurance. I have yet to recieve the negative or any sort of communication about the shipment.

    Would you please email me to let me know what is going on with this transaction as I would like the negative as soon as possible. You have perfect feedback so I assume you are a responsible seller and this is just some sort of mix up.

    Ok, so I PM'd the seller, again. I filed a complaint with Paypal and I still have no response. My wife PM'd him with her account on another item and he PM'd her back! But he will not reply to me, or ship my item. Do I wait another week before escalating my Paypal complaint into a claim? Dam, all I want is a reply from this person. Oh, and I got his addy and phone # from Ebay. Maybe I should call him?

    The guy is a fleabag. Call him, shows balls and gets results. File with Paypal, If the contact # is erroneous, the've violated eBay policy. Report that too.

    Can you post the auction -when it's straightened out?

    Before your 60 days run out, if you haven't gotten a refund from paypal then file an item not received complaint thru ebay and give him the feedback he earned.

    If ebay refunds your money they keep $25 for a service fee and you don't get shipping back but $40 or so is better than $0 or so.

I left a very polite message with my name and phone number asking for him to either call me or pm me and that if I did not hear from him by tomorrow I would just file a claim with Paypal for my money back.

    Yeah, that is strange. Since your wife was in contact with him about another item and he is avoiding you, I seriously doubt he plans on sending it.
    I would just get your money back from paypal and forget about it.

    More likely he just sent it and doesn't want to deal with you since the point will be moot in 2 days when you get it. Wait til Wednesday's mail and then get ugly on him.


    Just out of curiousity- when you purchased the negative (I assume it was a photographic negative) did you also get usage rights with it, so you can sell prints? Or just the physical negative?

    I am not sure about usage rights. I was under the impression that when you bought a negative you got the right to print as you saw fit. But of course I could be way off base. If anyone knows the exacts of the usage rights I would like to hear how the law reads. I own a couple of sports negatives and I have had no problem with Wal Mart making prints for me.


    I had planned on making a few prints, having Carl sign them and make my money back. I was thinking of a print run of 16 (his jersey number for the Braves) 8X10's signed and inscribed, a handfull signed to friends and one 16X20 signed for me.

    But it is looking like I am not going to get anything except my money back.

    I think you have already been more than patient waiting two plus week as it is. Strange a perfect feedback seller wouldn't give you a spare moment to reply. I'd definately start the Paypal complaint process as you can always cancel it if your package does arrive. Hopefully the post office simply put the package on the truck to Walla Walla instead of the northeast and it will arrive albeit very late. I am having my own fun. I recently had BGS slab some modern chrome type stuff and either BGS or FedEx entered the wrong local address. I live on 18th, not 15th. I can wait toward the end of the work week or pick it up on Tuesday. I'll grab it Tuesday making my 10-day BGS sub and 2-day FedEx service a combined 22 days.

    Update:

    I got the sellers phone number from Ebay and called him. I left a very polite message telling him I either wanted the negative or my money back and that if I did not hear from him in 24 hours I would file a complaint with Paypal. He called that night with an apology and said he "thought" he sent it out regular mail and that he would refund my shipping charge.

    Wrong answer! I told him I paid for insurance also and that I wanted a full refund. He said he would look for the negative and call me back. Today he calls and tells me he couldn't find it and that he would send me a check for a refund. I'm not too sure I like the check part. I paid with Paypal, I should get Paypal back. I'll give him a week and if the money isn't here, I will call again.


    On another note, I purchased another lot of negatives from another seller. One of them I thought was Joe Montana. Well, I get the package yesterday with a bunch of negatives I didn't buy and none of the ones I did. Along with them was a note stating that he "had sold the lot I purchased already but here is double the amount of negatives I purchased to make up for it." Thats not the point, I paid for a lot that had Joe, thats what I want. Not 5 shots of Ronnie Lott and a couple of Ray Wershing (sp?). So needless to say I emailed him and told him I didn't want them and wanted Joe. He replies that he has some more good Joe negatives and he will send me one. That I can live with. But I thought it was wrong for him to just assume I would want others and just mail them without asking me if I wanted a refund.

    I've never had this many problems on Ebay before. I'm really bummed about the Carlton negative, that would have been a sweet piece of my collection of him.

    Unfortunately, that's not correct. The copyright belongs to the creator of the image, and not the holder of the film.
    When I shoot a project for a client they license only that usage for the image that we've agreed upon. No agreement, no usage. Even though I send files (and before that, film) it does not give them any rights to reproduce or distribute that image without my specific written permission.
    If you are selling images, prints, or just using the images on a public site without permission you are infringing on the copyright of the creator. This can get very, very costly.
    I'm not an attorney, but have been an advertising photographer for 25 years, and have sat on the board of directors of both national photographers organizations. Copyright infringement is taken very seriously, and the small profits you might gain are not worth the tens of thousands it would cost you to defend and settle an infringement suit.
    Not sure where MLB, NBA, NFL, etc stand, but I think if you're selling prints of one of their events they would take some interest as well. They are all pretty specific about not allowing commercial use of any images or likenesses of their players or the events of the game without written permission.

    Thank you for that information! image I had been wondering what the laws were behind reproducing a negative. Your right, it's not worth the hassle.


    Maybe you can answer this for me too. Is it legal for me to make a copy for my own collection?

    As far as I know, you can do anything to it for yourself. It's just when it gets out in public that you get into trouble- selling prints, reproducing and publishing it on the web, tv, or print.
    My wife is a prop and wardrobe stylist, she has to be careful what artwork she hangs on walls in the background of sets, if it's not released the production company can be in big trouble.
