Of note, I am refunding fight-FRAUD's money in FULL. Hopefully, he will return the money from the refund back to eBay. It would be the honest thing to do.

I can understand him being upset about purchasing a refractor from someone who seems to deal quite a bit in this issue (as evidenced alone by the two subs that have been posted lately)
Nowhere in the auction does it say the card seems to be a little shorter than the others. Someone who is experienced in these cards know that they do vary quite a bit. For someone who sends in a bunch of these frequently, something had to be known or why not send it in with one of the submissions to get a 10?
The exact description in the auction states "It has perfect corners and edges, a pristine surface, and is PERFECTLY centered"
Seems like a 10 to me.
Not taking anyones side, but everything doesnt add up.......

The check is in the mail. It's only $135.50. I do not need people in my life threatened, false accusations being spread, etc. The internet is fine, but some people take things a little too far, as their line of reality becomes somewhat blurred.
Believe me, it is the smart thing to do.

I too am glad the seller edited his post as it was very,very inaccurate and I want
to clear up at least one point.
On Monday I sent the seller copies of the independent authenticator's report, a
Mail Fraud report, and a letter I wrote to a friend of mine who works for the
Postal Inspection Service. At the end of my letter I asked my friend to "Give my
love to Michelle and the boys." Apparently the seller has perceived this to be a
threat against his family. I didn't even know the seller had a family let alone their
names. It is not even a threat to my friends family. Hell, it's not even a threat.
jmbkb4, Thank you for finally agreeing to issue a refund. I truly wish we could have
settled this matter weeks ago but that was always up to you.
Reference your request to return the card, because of your longstanding unwillingness to
accept the conclusion's of the independent authenticator and your, as well as others,
insistance that PSA's opinion is the only opinion that matters I finally sent the card into PSA
this morning. If they still grade the card, regardless of the grade it receives, I will of course
return the refund you are sending me. I had intended to destroy the card if it was rejected
but one of the board members was kind enough to point out the unfairness of that to you.
If they refuse to grade the card I will honor your request and return it to you.

Just to let you know, fightfraud, not that it matters to you, you have been blocked from my auctions. I hope this eats away at your conscious for years and it drives you out of the hobby. Your actions have seemingly been nothing short of dishonest and unfair.

Since he has been SOOOOOOOOOOOOOOOOO willing to fire off about me, with letters to the hospital I work at, threatening letters to me and my family, and threats of suing me in civil court, the LEAST I can do is ask fight-FRAUD:
1. Why are you defrauding eBay out of over $100?
2. Where is the "trimmed" card that you don't seem to want to give up??

This is because so many people have been threatened before that they have had medical problems from the threats and sold items they did not need too. Only to have the person not sue them. Many states enacted this law, but it is not well known..

Law suits are indeed very stressful. Anything that one is not used to is stressful. So, one should never threaten a lawsuit in writing that he is not going to follow through on.

Every state has different laws...better check up on the State you live in.
"Malicious prosecution" involves a CRIMINAL trial...not a CIVIL TRIAL/Case, which is what was allegedly threatened in this instance.
