Seller didn't honor the "buy it now" according to the ebay forum comments.
But the seller basically told the truth about the cards although I believe these cards were put together years later than the seller states, perhaps in the late 60's or early 70's. And I would highly question the NM+ grade opinion of the seller. Cards sure look EX - EXMT to me.

This is a really cool item, a 1958 Topps Baseball Holiday rack pack in outstanding condition. Taylor, Don Drysdale, and Ernie Banks All-Star are on the front and Hyde, Dick Brown and Ferrarese on the back. This pack was made back in the same period of the cards by a third-party vendor at the end of the season to sell during the holidays. Pack contains 12 cards that range from EX to NM+ condition. The cards are 100% authentic Topps baseball cards and the neat thing about this pack is that you really could pull any card from the set including stars from this year. Originally purchased from The Baseball Card Kid.
The same thing happened to RichG a couple weeks ago. He realized it was a typo and he did the right thing. He let the seller out of it, no harm no foul. The seller made a mistake, he didn't mean to offer the cards at that price.
Sandiego Will only does auctions that start at .99 so somehow this was accidently listed as a BIN, although I dont get the 29.00 price. People are too quick to jump on a reputable seller that made an honest error in his listing. Ebay rules or not, everyone makes mistakes............
from what I understand from the thread, the seller (sandiegowill) did not contact the buyer with an apology/explanation, he simply told him that the rack pack "was not available." we all obviously make mistakes but i think what our actions are afterwards are really what measure our character.

I agree with the last poster in that thread. I would file a NSS on the seller and if he files for his fees back mutually I would not agree with it. Just as buyers are held responsible for their mistakes sellers need to be liable for their mistakes.
Especially if his response to it was as stated, that the item just is unavailable.
