Fact is, no seller has any obligation to sell anything to any bidder. Ask eBay customer service - they'll tell you.
Completely different is the situation if you paid for the item via PayPal with a credit card. Then there is the issue of "item not received" and you will win on that one, and get your money back. If not through PayPal, then through a chargeback with your credit card issuer.
Moral of the story is to pay for all eBay items with a credit card via PayPal. You will always be able to get your money back, one way or another.
Good luck with it.

We have concluded our investigation into your claim.
We have decided in your favor and have recovered funds from the seller. We were able to recover $113.91 USD and this amount has been credited to you. Please allow five business days for this adjustment to be posted.
If you are due any additional amount from the seller, we will make our best effort to recover the balance from the seller.
If the seller's account has insufficient funds to complete the refund owed to you, please be assured that we will take appropriate action against the seller's account, which may include limitation of the seller's account privileges.

Now if you could just get your money back on the 1917 quarter! That must have been a heart break, and the jerk had the balls to say you knew about the cleaning and that the auction was as-is, I looked - both lies.
Oh well - that quarter was the first neg I gave out, the money does not bother me so much as having to deal with a less than nice person. At least the next person will know!

I doubt it. It's the same kind of stuff he sells all the time.
My guess is he's disappointed you won the auction at a better-than-usual price.
