    My guess is it's residing in a bodybag marked "genuine, damaged" or somesuch. A very cool coin though.

    In this case, I suspect the guarantee is implied and enforcable regardless of what PCGS says or doesn't say (I am not an attorney). If they put out a holder that says "genuine" on it, and are in the grading business, there is an implicit guarantee. Sort of like a Mercedes dealer selling a Mercedes with a "Mercedes" logo on the front windshield - if the car turns out to be anything else, you have an actionable case of fraud.
