Shipping refunded on ebay purchase?

Say you win an item on ebay and receive it only to find out it was mis-represented and does not work for your application even though the auction said it would. Would you expect a full refund including the shipping you paid to get it?

The reason I ask is, I won a set of center caps and the auction stated they would fit my 87 Iroc wheels and that they measured 2.5" in diameter. They are barely over 2.25" and therefore I cannot use them. I emailed the seller and he still has not replied, so I am sending them back.

Tonya disagrees with me and says I will be stuck paying the shipping. I just cant see that since the auction was mis-represented. I am already out the money its gonna cost me to send it back.

What do you guys think? Is it out of line to expect a full refund?

    From my POV - you're not out of line if the item is a mistake.

    But, that doesn't mean the guy will do that.

    But, good luck - if the guy is classy and realizes their mistake - they would want to make good.

    How much was the shipping?

  • I agree with you. If the buyer misrepresented her item she should give a full refund including shipping costs both ways.

    If the seller's representation is exactly as noted above,
    the seller is supposed to eat the first-round of shipping.
    If the seller is a good eBayer, they would also pay the
    return postage.

    You might have the best luck if you "assume" that the
    seller sent the "wrong item." Ask her to replace the
    wrong item with the correct item.

    SIDE NOTES:
    If an eBay item is sold with "Free Shipping," or "Shipping
    Included," PayPal makes the seller give back the WHOLE
    amount. In the event of a USPS insurance claim, the USPS
    may deduct the amount of the postage, even though it was
    "part of the purchase price."

  • I don't think it's unreasonable to ask for shipping both ways, afterall, it was the seller's fault.

    Has that ever happened to you? Everytime I've filed a claim, they refunded postage, insurance, DC, etc. I don't think they can charge someone money for stealing their package?

    It did not seem right, but I NEVER argue with the postal clerks
    anymore.

    Item sold for $ 58.00, including postage.
    Insured for $ 50.00.
    I submitted the signed claim, the item's sales ticket
    and the postage ticket for about $ 4.00. (Insurance/DC/Postage).
    They paid me $ 46.00 and change. (Postage+fees deducted.)

    That was last November or December.

    I have, in the distant past, gotten the full amount,
    I think. That is why I said they "may deduct" blahblahblah.

    Thanks all. Mike, shipping was $10.00, total purchase was $60.00. One thing in my corner is the fact that I used my credit card. Its alot easier to fight stuff like this when a credit card is used.

    The thing that bugs me is the fact that I emailed this guy and basically thanked them for the fast shipping and explained the item was wrong. I even said if you have the correct size send them and we can avoid the refund mess. That was last week. They still have not returned my email.

    You did right by emailing him a polite letter. Give it a few more days and then start the process with paypal or credit card.

    Just to add - I remember someone posting here that paypal tried to punish them for not giving them first crack at fixing the situation before going to their credit card company.

    You are correct. I and others on this board have pissed off paypal because we went to our credit cards first instead of them. I don't know if lawnmowerman used paypal or straight credit card. If he used Paypal, he should go through them first. Paypal is better about listening to customers when an item is clearly misrepresented (more so than in in the past).

    I used my credit card thru paypal. I will give the guy till next week (I shipped it back to him today). If he doesnt respond, I will go through paypal first. Then if necessary my credit card.
