ebay question - seller backs out of deal - what are my options?

I won an inexpensive card (Topps Fan Favorite - Ron Guidry auto) for $10 along with a couple of other cards for $15 each. I pay by paypal and then get the note below. Should I write it off as the guy made a mistake, or does it sound fishy? My response is to write it off as a bad transaction and find the card somewhere else.

listed the Guidry which had already been sold. I even checked
my personal collection to see if I had one there for you- but I did
not. I will be sending your package with a check for $10.01 to
cover the cost of that card. Again, my sincerest apologies.

That is another one of those stories that I have heard dozens of times. I can almost guarantee you the card will be relisted ina week or so. Most likely he did not get the price he wanted for it and chose to blame his wife.

I see your point and yes, if I was the winner of this auction I would keep an eye out to see if he would relist the card in the future, but I can totally understand how a mistake like this can happen. When mistakes occur, it is the sellers responsibility to correct it. In this case, the seller did by refunding the money (However, I would have added a little more to make up for the buyers time).

True, but under Ebay's rules the buyer can still report the seller. If he has had a history of doing this and been reported before then filing the NSS could get him suspended and that will tell the tale.
If someone buys before I catch the error, I have had to send a similar note to the one that tkd7 got, though the angle of blaming on the wife is something I hadn't thought of!
What I say is that I had previously sold the item, apologies, and offer to give free shipping and insurance for a previous purchase. In all cases the buyer was OK with it, and only in one case did the buyer refuse to cooperate with the NPB process to help me get my fees back. A couple of buyers even subsequently bought something because of the free shipping offer. For you buyers, you DON'T get a NPB strike in a case like this, or when you return an item to a seller. The only NPB strikes that count against you are the blatant non-payment ones.
I'll agree with filing the NSS complaint for the reason that you mentioned. Mistakes do occur, but they should not occur very often. In my profession, anytime a pharmacist makes a mistake he is required to write it up and keep track of them. Even though mistakes will be made, they better not happen too frequently.

I'm not sure a seller would make up a line like this just because he only got $10 for a card with a $40 BV. As far as "honor my mistakes" goes, seems to me that that is exactly what he has done. First he checked his personal collection (I've done that), then he refunded the money. I have no problem with how it went down. File the NSS if you need to, then move on. Honest mistake by the seller IMO.

I'd give the seller the benefit of the doubt in this case, especially if he has decent feedback. Regardless if the whole hospital story is true, if he doesn't have the card, he doesn't have the card, and he's doing what he can to remedy the situation. Take him up on the 15% discount, if possible, and you come out ahead.

eBay is definitely hazzardous to your physical health. If one is not
cautious on eBay, it can be hazzardous to their fiscal health, too.
If I was the buyer in the subject transaction, I would "just move on."
But, I do not buy the seller's tale. MANY sellers tend not to want to
honor their deals if their items do not bring what they thought they
would bring.
As a buyer, I never complain. As a seller, I seldom explain. It is
usually a seller's "explanation" that makes him appear to be a
dishonest vendor.
