Any luck w/ Paypal claims for items not received?

Just looking for some responses....
A couple of weeks ago I placed 3 orders with an EBAY (gradedcardsforsale) dealer for graded Dirk Nowitzki cards. He also sells on ebay under bgsgradedrookies and on naxcom under Superior sports. The dealer shortly after got NARU'd. I only received 2 of the 3 orders, and DIDN'T get the highest value on (about $125). When I opened a paypal claim, the dealer responded and said that he sent me two orders and gave the deliv conf #'s. Yes 2 were delivered and signed for by my wife, butl he seems to have forgotten about the 3rd one. I have given all the details to PAYPAL, eventhough they have them since they were all paid by PAYPAL.

As recently as this morning (almost 2 weeks later) the seller emailed me and told me that he will be forwarding the 3rd deliv conf # to PAYPAL in a few days. WHY SHOULD THIS TAKE A FEW DAYS IF IT WAS MAILED 2 WEEKS AGO? My thought is that he has since mailed, or is soon to mail a 3rd package and i will probably get a pile of junk in it, but he will have his deliv conf# and it will show delivered. I have corresponded w/ paypal about my prediction so that it is all on file in advance of me getting the 3rd shipment?

any one ever experience spomething like this?

    I believe there is talk of this being one of the alleged trimmers of recent BGS cards, although that wasn't your question.....

    Yes - I have encountered all sorts of crap with Paypal. If the seller CANNOT provide a delivery confirmation #, and you file a claim in the appropriate amount of time, you WILL receive your money from paypal (provided it was paid with a credit card, and NOT a paypal balance).

    And yes, the seller can send you a load of crap, inside a package, with a DC #. I've heard of it happening, and you might have a case there....although my case of "...items not as described..." went nowhere with paypal.

    Hope some others can offer you more info!

  • thanks for the reply.....i just hope to get Paypal to realize the potential scam he might be trying to pull. I really want the cards, not the $. I am just shocked because i have had numerous transactions go good with him...but if he still can't provide the tracking and insurance # what else should i believe. It has been almost 2 weeks and all of his other packages always arrived in 2 or 3 days...
  • So it sounds like you are better off to pay for something on Paypal via credit card and not your balance.... I did not know that

    You file an item not received for that one, and there isn't much he can do. If you already filed a not as described complaint you have to stay with that complaint, I don't think you can switch.

    I filed once for some nice prints that the seller mispackaged and they were destroyed. I didn't pay for insurance but when I submitted pics of the packaging they ruled in my favor.

  • Filed a claim several months ago for a small transaction - a card I never received and another claim for another card I never received, this time a $450 claim about three weeks ago. In both cases, the seller's account was terminated during the claim period. The first claim was never recovered but I didn't lose much. But, I wondered what all that crap was from PAYPAL with respect to insugin my purchases. The fact is, they didn't. The 2nd case is still open so we'll see what happens but for some reason, I am skeptical. I'll be livid if they screw me over again. In the meantime, I started paying with PAYPAL credit (credit card) for those transations where I have never had any history with the seller. One thing I do know is that if I call my credit card company and make a claim, they have always reversed the charge in the past for items not received. However, I never requested this for an EBAY transaction so I guess I will have to wait and see. I spend thousands of $ per month on cards through EBAY and frankly, I don't get the impression they give a s*** about where their business comes from or providing customer service. So, I have started to migrate away from EBAY and deal directly with bonafide dealers whom I trust and do business directly with them. I don't know how much the transaction fees or lsiting fees are for EBAY but I have to think that if you added up the fees based on the cards I purchased over the past year, they made a hell of a lot of money off those sellers. I don't trust their system anymore and I have zero confidence in their customer service. Maybe they will prove me wrong this time around but I am skeptical.

    Actually even if you use your balance if the seller cannot prove DELIVERY and shipment in 7 days they will do what they can to get your money back.

    Were these auctions paid for in one payment?? If so and he provided a DC that shows delivery to you, you are SOL with them.

    Always if possible pay with a CC when using Paypal. Why do you think they try to make you go with your bank account first??

    If you ever have to file with your CC be sure you go through Paypals procedures first otherwise they can and usually do suspend your Paypal account for not following their rules.

  • They were 3 seperate payments on 3 seperate days. He is going to have to pull a rabbit out of a hat to get out of this one...He has come up with only 2 of the deliv conf's....and that was over a week ago...

    My hunch is you'll get the card in a few days and that's when he'll enter the DC #. However, I have spoken with paypal about this situation, and the rep said it would be a good idea to open the package in front of a usps employee if I believed the seller was going to send a different item. Then at least you'd have a witness.

    I don't understand why the seller wouldn't just tell you that he forgot about the 3rd card and sent it late, but card dealers aren't always logical.

  • Believe this or not.....now he files ITEM NOT PAID FOR against me with EBAY !!!!! The item was clearly paid thru Paypal. Today I spoke to EBAY and PAYPAL - both know all of the paymant details...WHAT IS THIS GUY THINKING ????

    Also - his NARU has been removed on EBAY.....BEWARE OF gradedcardsforsale ON ebay.

    Wizard is correct about this, but I didn't explain my point well enough.

    Paypal will do what they can to get your money back if you paid with your Paypal balance PROVIDED that the crappy seller didn't clean-out his paypal account and delete his bank account number from their system. If that happens, Paypal will give you the "so sorry, we tried" line. And in their defense, they cannot do anything else.

    If you pay with Paypal via credit card, and Paypal cannot collect for whatever reason, you can still file charges with your CREDIT CARD company. I have done this, and I must say, Discover did a nice job of getting my money back!

    So indirectly, yes, it IS better to use a credit card, NOT a paypal balance, to pay for your items.

    Remember, you can have 2 paypal accounts - one for RECEIVING PAYMENTS and one for SENDING PAYMENTS. That way you'll never have a paypal balance in your account, and you can always use a credit card.

    I haven't had any problems yet using this system.....maybe I've been lucky???
  • This scumbag, gradedcards , has now given me 3 ITEM NOT PAID FOF STRIKES. How can he do this? Paypal and EBAY have the info that it was paid for, how can a seller just unmark an item as sold if the paypal info is in the transaction? Anyway i now have to copy the paypal transaction details and fax it to ebay....WHAT A WASTE OF TIME!!!

    Help me fight this guy and PLEASE DON'T BID ON HIS ITEMS!!!!!!
  • Please everyone BLACKBALL this guy on your sellers lists..... his EBAY id's are: bgsgradedrookies and gradedcardsforsale. He has really turned this thing ugly on me....now i have to waste my entire Monday trying to fix my 3 strikes on EBAY.....
