New a little help.

Seen some of this before, but need some advice. Long story short...bought a item on ebay - $250. Paid with paypal. Turns out it is a phoney. Buyer is not being coorperative. I have turned in a claim with paypal. Got a note telling me that I need to file a police report. More than happy to, but need some ammo. Mail fraud? what's the process? Anyone have anything that I can put into an email and scare the seller? I just guessing that if I sounds like I know the process and communicate the risks/process to the seller that this might make something happen.

    Now, you paid with paypal........balance transfer? Credit Card?

    Seller used Delivery Confirmation?

    The horror story seems to be that if the seller can prove that you received the item (Del. Conf.) that you might be SOL.

    Have you obtained this guy's phone number using the ebay system? Get it and call him and tell him exactly what you intend on doing if he doesn't make you whole.

    I would contact HIS Police Dept. and request to make out a complaint for Theft/Fraud. Ask if they intend on contacting him to follow up if they take the report from you. If they refuse, try talking to your PD and do the same.

    I would also contact your PO and his PO and see which one would like to handle the complaint of mail fraud. I'd try his first to see if they have had other complaints on the guy.

    If all else fails and you paid with a credit card, dispute it with them......but be prepared for paypal to dump you if you do that.

    If I'm reading right you bought something that was supposed to be one thing and ended up being something else? If that's the case you can file an "item significantly not as described" with both paypal and ebay. Make sure you file in time, since they won't talk to you after your time expires.

    You might need to prove that it's not what it was supposed to be. Make sure you print out and save to your computer the complete auction including all photos he used in the description.

    If it's a card take it to a couple reputable card shops and get on their letterhead or paper with their logo or stamp that it's not as described and why. Also have them put down what they think it's worth in it's current condition.

    Like Goose said maybe give us the auction # and what you think it wrong with what you got, somebody here will help for sure!
