Did not receive coin. What would you do.

I won an auction on Ebay on 3/27. The total was $370. The seller offered free shipping and Insurance if paid by Money Order. I sent it right out and he acknowleged receipt of it on 4/4 and left me positive feedback. He sent it out on 4/6 from Denver with Ins & Delivery confirmation. I'm in NY. He is going to file a claim, but has to wait 30 postal days. He works in mail operations for the State of Colorado. He said it may take as long as a year to be settled, or the claim may be lost or closed and you lose the claim. He suggested that we settle for 50% each and regard it as an unfortunate loss. My question is, as the seller should he refund my money in full now and pursue his claim with the P.O. , or do I accept $185 and hope somewhere down the line he gets payment from the P.O. and sends me the rest. Should I file with Ebay before the 60 days are up? He has over 400 positives and no negs. All suggestions are appreciated. Thanks.

That should not be your problem, so I wouldn't accept his 50/50 offer. The fact that he even suggested such an arrangement makes me think that he is either uninformed or trying to take advantage of you.

His contract with you is separate from his insurance contract with USPS (although you gave him the money for that). He needs to pay you in full now, then fight his own battle with USPS. How long it takes is his problem.
Also what's this BS he's giving you, about the claim could be lost or closed and then you lose the claim?? That could never happen. YOU don't have to make a claim, it's HIS claim. HE'S got a receipt for the claim, he hounds them till they pay up. That's what insurance is for.
If he works for mail ops he should know better. This just raises so many red flags.
Ask him to shoot you an image of all this. Numbers mean nothing. He could have shipped any package at that time.

Stick up for your rights, and demand an immediate refund of everything you paid. Forget about the coin, it is not worth the trouble you already have experienced.

I'd wait awhile before posting a NEG. If he has a good feedback record, give him a chance to make things right. The Post Office has been known to "lose" packages.

Well I happened to need to go to the post office to pick up a package from pcgs and psa/dna (a couple autographed balls) so I picked up a
"Domestic Claim or Registered Mail™Inquiry" and scanned the pertinent area.
Let us know what happens!

Used to be 30 days. The change to 21 days is recent.

Even if that can be done, I'd suggest demanding that the seller reimburse the buyer NOW, instead. The bottom line is that the buyer did not receive the item he paid for and is entitled to have his money refunded. The problem of and delay in collecting on the insurance coverage from the PO should be the seller's/shipper's, not the buyer's.

I have had a few people contact me after a few weeks of not receiving their purchase. My standard line was that I would file a claim
at 30 days, and that after completion of filing, including the buyer signing the USPS form for non receipt I would refund full purchase
price minus shipping 30 days later. 9 out of ten packages were either delivered by then or I made the refund.
This guy is a scam artist, and I would wait for the insurance to go through.
I had one insured package for about the same amount take 40 days to deliver. I porvided the seller all the details. After 30 days AND seller signed the paperwork, I processed a refund.
The PO refunded me about 10 days later. On insured (Not registered) the claims go quickly. Registered on the other hand does take up to 1 year, as the postal inspectors get invovled.
Don't take half the money...you loose your claim.
My best suggestion is to let the seller know that you intend to file mail fraud charges if he doesn't refund the money. If he is truly a postal worker, then that should put a little scare in him.
