Did not receive coin. What would you do.

I won an auction on Ebay on 3/27. The total was $370. The seller offered free shipping and Insurance if paid by Money Order. I sent it right out and he acknowleged receipt of it on 4/4 and left me positive feedback. He sent it out on 4/6 from Denver with Ins & Delivery confirmation. I'm in NY. He is going to file a claim, but has to wait 30 postal days. He works in mail operations for the State of Colorado. He said it may take as long as a year to be settled, or the claim may be lost or closed and you lose the claim. He suggested that we settle for 50% each and regard it as an unfortunate loss. My question is, as the seller should he refund my money in full now and pursue his claim with the P.O. , or do I accept $185 and hope somewhere down the line he gets payment from the P.O. and sends me the rest. Should I file with Ebay before the 60 days are up? He has over 400 positives and no negs. All suggestions are appreciated. Thanks.image

    Something "stinks" here. The seller is responsible for delivery. He should refund you your entire purchase price.image

    If the coin was supposedly insured I would settle for nothing less than 100% of my money back. Less than that shouldn't even have been suggested by the seller.

    If you paid for insurance and do not receive the package, I believe it it the seller's/sender's obligation to refund your money. He can attempt to get reimbursed from the PO, himself.

    That should not be your problem, so I wouldn't accept his 50/50 offer. The fact that he even suggested such an arrangement makes me think that he is either uninformed or trying to take advantage of you.

    Well that is what I was thinking. Insurance is supposed to protect the seller, not the buyer. Should I ask for a full refund now and if I don't receive it soon , file with Ebay?

    Too bad you didn't pay using PayPal. You'd have your money back in 10 days tops. Is the deadline to file non-receipt with ebay 30 or 60 days?

    Sounds pretty fishy to me too. My gut feeling is if you settle for half now, you'll never hear from him again.

    His contract with you is separate from his insurance contract with USPS (although you gave him the money for that). He needs to pay you in full now, then fight his own battle with USPS. How long it takes is his problem.

    Also what's this BS he's giving you, about the claim could be lost or closed and then you lose the claim?? That could never happen. YOU don't have to make a claim, it's HIS claim. HE'S got a receipt for the claim, he hounds them till they pay up. That's what insurance is for.

    If he works for mail ops he should know better. This just raises so many red flags.

    Do you have proof the seller insured it? Sounds like a "self insurer" that everybody sticks up for.... and doesn't want to dig too deep into his war chest. Why else would he want to split the cost?

    Yes. He gave me the Ins and delivery confirmation #'s. When I enter them at the Postal web site, it shows the item was accepted for delivery in Denver at 7:21 AM on 4/6. Nothing after that.

    OK, maybe not one of the self insurer's (this time) but seems odd he would want to settle with YOU real quick. And make you take a loss.

    Ask him to shoot you an image of all this. Numbers mean nothing. He could have shipped any package at that time.

    I think you should be getting the message by now, after reading all the comments above.

    Stick up for your rights, and demand an immediate refund of everything you paid. Forget about the coin, it is not worth the trouble you already have experienced.

    At the very most if you are feeling generious you can wait for your refund till after the 30 days it takes the PO to settle with the seller. But settle for nothing less then a full refund. I have had stuff I have sent lost by the PO twice in the last couple years. And at the end of the 30 day period I walked into the PO and they handed me my money.

    Sounds like he is trying to hornswaggle you. why should you settle for half when the claim clears he will get the full refund? i dont get it? i have filed claims before and they always paid-even though it does take some time-up to- months. demand a full refund and nothing less. his offer is poppykock.

    I know someone in VA that once received a insured priority box from CA 3 months after it was mailed intact. No one knows where it was but I suspect it was in the bottom of a mail tub in a stack somewhere.

    I'd wait awhile before posting a NEG. If he has a good feedback record, give him a chance to make things right. The Post Office has been known to "lose" packages.

    I am 99% sure a claim can be filed after 3 weeks. He should pay you 100% now and the work it out with the post office.

    Well I happened to need to go to the post office to pick up a package from pcgs and psa/dna (a couple autographed balls) so I picked up a
    "Domestic Claim or Registered Mail™Inquiry" and scanned the pertinent area.

    Don't take half. He will file claim and get his money back. If you except half that means he will make over $555.00 for the coin. Your half plus the full claim amount. He's scamming you.

    Used to be 30 days. The change to 21 days is recent.

    I had to file a claim last summer (7/05), it was 21 days then.

    I would not neg this seller unless they refused to refund, ... pronto.

    Have him file the claim and tell you when it was filed. I believe he can even designate you as the payee for the claim. You'll have to sign the claim form affirming the item wasn't received. The P.O. compares signatures on the claim form with the delivery receipt that needs to be signed when the item is delivered. When you get the claim form, you'll be able to see how much insurance was purchased. Perhaps his offer of 50% came from the fact that he tried saving a few bucks by underinsuring.

    Even if that can be done, I'd suggest demanding that the seller reimburse the buyer NOW, instead. The bottom line is that the buyer did not receive the item he paid for and is entitled to have his money refunded. The problem of and delay in collecting on the insurance coverage from the PO should be the seller's/shipper's, not the buyer's.

    I have had a few people contact me after a few weeks of not receiving their purchase. My standard line was that I would file a claim
    at 30 days, and that after completion of filing, including the buyer signing the USPS form for non receipt I would refund full purchase
    price minus shipping 30 days later. 9 out of ten packages were either delivered by then or I made the refund.
    This guy is a scam artist, and I would wait for the insurance to go through.

    Packages can take a long time to deliver.

    I had one insured package for about the same amount take 40 days to deliver. I porvided the seller all the details. After 30 days AND seller signed the paperwork, I processed a refund.

    The PO refunded me about 10 days later. On insured (Not registered) the claims go quickly. Registered on the other hand does take up to 1 year, as the postal inspectors get invovled.

    Don't take half the money...you loose your claim.

    My best suggestion is to let the seller know that you intend to file mail fraud charges if he doesn't refund the money. If he is truly a postal worker, then that should put a little scare in him.

    Good luck. Hopefully he'll see that he can't fool you and he'll do the right thing and refund all your money as soon as it becomes available.

    Isn't it amazing how many packages and letters with valuables get "lost"?
    I've had 2-3 things go missing in the last 2-3 yrs out of about 120-140 mailed. I feel that's alot.
    How do theives know which packages/envelopes to open?
