I had 2 listings for 2006 heritage SP "pick 10" lots. I had a decent run for awhile before they found out about my "illegal" auctions. They explained that the auctions circumvented their fees. I wrote an e-mail to them saying...
Message: Exactly how is an auction that provides a "choice or pick " a
circumvention of fees?? I want an actual answer, not some textbook
answer that states a policy.

We'll see what their answer is. It's kind of B.S. about their astions since nobody is getting ripped off. The seller gets what they want and Ebay gets their fees all the same. It's just a regular auction.

Someone might have reported you. Could be someone selling the same. I ran couple auctions about those selection cards and i got reported. i thought it's their system picking up those words "pick, select" words but I saw some auctions different from mine running several times from some sellers without problem. So I guess someone reported me. Did they refunded your insertion fees. I read somewhere on ebay that they will no longer refund those. Don't known if they did push through with it.

I suppose the wizard thinks that he can make more money off of you if you are forced to do the auctions with specific cards and have the auctions close with no bidders, thus taking more listing fee money from you.

List 10 specific cards you have for sale, but then in the description for the auction, say that you have a varied assortment of cards from this set, and that potential bidders can send you an "Ask the seller a question" before bidding and tell you what cards they need. If you have 10 of the cards from their wantlist, you reply "Go ahead and bid--if you win the auction you will get the 10 cards you want".

To begin, please accept my apologies for the upset that our
administrative action has caused. I have thoroughly reviewed the
information you have provided as well as the information in your
account. I have come to the conclusion that the appropriate action was
taken in this case in accordance to our listing policy. Please allow me
to further explain why this action was taken.
Please understand that offering a choice of pre-made items is not
permitted under our Choice guideline which is now under our
Circumventing Fees policy. As you know, eBay makes it's fees based on
the number on listings going live to the site. Auctions where a seller
is giving the bidder the option to choose which items he would like
defeats the eBay fee structure. Also, listings such as the one you have
listed is potentially confusing to bidders as they would be unsure of
exactly what you are offering. It is also unfair to those members that
do list their items appropriately. Choice listings can be problematic
because of the potential for fee circumvention, transactions outside of
eBay, confusion amongst bidders and other issues.
To bring your listing into compliance, you would need to offer each
card
in separate auctions.

I understand that this choice policy is a little confusing at times,

the point of it is to prevent sellers from giving a choice of pre-made
items. The last thing we want to do is to have bidders upset because a
seller offering choice of a pre-made item has run out of stock on a
winning bidder's particular choice.
I realize that it was not your intention to be in violation of our
guidelines and that this most likely was an honest mistake. Please
understand that this action is in no way meant to question your record
with us as a valued member of the community. However, we must strive to
maintain fair and consistent guidelines amongst all of our members.
I would like you to know that when eBay cancels listings, we refund all
fees associated with creating the listing. At this time, however, we
are
unable to actually relist auctions for our members, or send them copies
of the removed items. You are completely free to relist, at your
convenience and with the required corrections.
