How would you handle this eBay situation?

Ok...buy a card from a guy with ~55 rating 99%+ feedback for $150 BIN. Paid immediately through Paypal (thankfully) and guy emails me back last night saying that card will ship out Monday USPS. Late this afternoon I get an alert from eBay saying the following:

Our records show that you were a bidder or buyer of one or more of this seller's items. We recently removed this seller's active listings and suspended the seller's trading privileges. Due to privacy concerns we cannot share further details about this seller.

If the seller asks you to complete this transaction outside of eBay, we strongly recommend that you do not proceed with the transaction. Transactions for items listed on eBay but then completed off of the eBay platform are not covered by buyer protection programs offered by eBay and can be highly indicative of fraud. For more information on Offers to Buy or Sell Outside of eBay, copy and past the following Help Page link into your browser: http://pages.ebay.com/help/policies/rfe-spam-non-ebay-sale.html.

If you have already paid for this item but have not received it, you should take all possible steps to receive reimbursement.

1. Stop payment with your bank if you paid by check.
2. Contact the Security Department of your credit card company to file a chargeback if you paid via credit card. 3. If you paid via Western Union or MoneyGram, contact the company directly (Western Union 800-325-6000 or MoneyGram 800-926-9400). 4. If you paid with PayPal, you may be eligible for up to $1,000 USD coverage at no cost. To file a claim with PayPal, login to your PayPal account and copy and paste the following link into your web browser: https://www.paypal.com/cgi-bin/webscr?cmd=_protections-buyer-outside Scroll down to the bottom of the page and click on the File a Claim link. PayPal claims must be filed within 45 days of the close of the listing. It may take at least 30 days to complete the investigation and resolve the dispute.

Anyway, I email the seller and he says that the card will still ship out tomorrow and he will give me a tracking number. (So, I am thinking everything is cool). I email him back asking why they suspended his account, and he gives a reply that has a lot of broken English and really skirts the issue. So I email him back asking if he could ship UPS ground (he is only 1 state away so ground would take 1-2 days at the most) and the tracking number would be more useful to see if he really shipped it. What concerns me is that he might ship the card (then everything would be great), but what's to prevent him from shipping an empty box and having the tracking info? Then it would be my word vs. his (I think I still would have the upper hand in that he is now NARU'd. I have 30 days I believe to dispute it through paypal, but it would take a crap load of time to sort out, and I don't want to even mess with it unless I have to.

Right now I told him that if I don't receive the card by Friday I will be forced to dispute the Paypal, but what concerns me is his real lack of the English language in his emails...

examples:

Ebay sucks they kill the little man. I colected for many years. I know more about him than anyone. I'm suprized espn has not called me. He is a great ball player and will continue to clime the home run charts.


Payment and I cant get it cleared until the morning. I will ship it ups if that is better for you. I have sent them the money and it still has not cleared. I have tryied all I can until the morning. I will let you know asap when I get the info on tracking

  • I'd definitely file the PayPal charge and, if this guy miraculously comes through, you can cancel the claim.

    Its sounds like Ebay shut him down because of non-payment on his "EBAY" account.

    Would you not wait a few days before doing so? I mean if I file the dispute say tonight and the card shows up Tuesday, then we're talking about a mess w/ paypal right? (or can I reverse it through paypal saying that I received the item after I file the dispute?)

    I am leaning on waiting a few days and seeing what happens, just wanted some fb as to what others might do...mostly curious to if I can "reverse" the dispute if the card arrives...

    Sounds like e-bay cancelled because of non payment. I'm thinking he will ship and you will the card. I'd wait until Friday and go from there. He hasn't done anything wrong yet to you so give him the benifit f the doubt. My guess is e-bay will get his payment and he'll be reinstated. Just my 2 cents. Joe

    if you get the card then you can just close the paypal dispute and that would end it - pretty simple, not much to it. you could always get the guys phone number and give him a call.
  • he just sent me his phone number if there's a problem, so things should be ok...
  • Good luck sandmanfromlv !! Ebay dispute notice gets used early by many sellers and you may not have a problem. I had someone from Canada follow Ebay prompt for a second invoice that shut me down for 24 hours and I have a 400 + 100% feedback. He did not mean to but Canadian mail is sometimes like the Pony Express!

    what if you open it at the post office in front of the postal employees? is it still your word against his word? it certainly sounds like mail fraud to me if its an empty box or a box with scraps of paper in it.

    sounds like you won something from a hijacked account.

    I have a secondary ebay username set up solely to bid on auctions where I am 100 percent sure they are scams....such as stolen images, etc....

    Each time ebay ends the listing, I get the same email.

    The broken english scared me too. However it was stated the guy was 1 state away?


    How with paypal did you pay? transfer or CC?

    Excellent idea about avoiding the empty box issue. Just open it in front of a postal employee after explaining the situation (it always helps being friendly to service personnel in all fields because situations like this make them essential). Empty box is a certain mail fraud issue.

  • Card received today in excellent condition....seller never said why account was NARU'd....go figure...to be evil, I could file a dispute, although he did do confirmation (PO left it in my mailbox w/o signature required)...but I would go straight to hell....(although I would probably join the rest of my friends....image
