What are the chances of me winning/losing this?

Actually, this is about a Paypal claim I just made. I received a card that had a surface wrinkle/crease about a half an inch and it resides in the top middle. Card came in a top loader in a flat envelope. Seller says he didn't recall any kind of crease on the card and it was probably due to postal neglect and doesn't warrant any kind of refund on his part. So I filed a claim w/ paypal stating my position and the seller responded to paypal disagreeing with my statement. So now paypal says they will review and then decide. My question is, do you think they're going to do nothing and just ignore it because it looks like he's going to stand firm. Am I going to be out of my money? I should of gone with non-receipt since he also didn't send it with any kind of confirmation and his feedback sucks. Under 99% now with my latest addition. Anyone else go thru this and lost?

    How much money are we talking about?

    The seller did not use a bubble mailer?

    IMO the seller should refund the money as he shipped it in a way that it could be damaged.

    No bubble mailer was used. A little over $19.00 total. Charged $2.50 for shipping. He used one of those large manilla flat envelopes with .53 cent postage marked on it. I went back to the original scan to see if I can see anything, but take a look. "Black Diamond" is written on the very top and the surface crease runs from the top of the "B" to the bottom of the "B". It's a foil card, and I'm wondering with the surface crease, if it made a reflective glare on the scan....I think I see a hint of it. You should see a piece of silvery/white to the right of the Upper Deck logo on the top left. The little spec is part of the surface crease.the auction

    Did you ask him what kind of condition the card is in, as it clearly does not state any condition nor does it say there is a crease.

    No, I didn't ask the condition prior to the auction ending. For modern cards, I'm assuming nm-mt or better. Because I didn't ask, would that be a loophole for sellers to sell cards without stating condition and as is? I don't think it would be right if there was a huge blatant crease right down the middle of the card which may or may not be picked up thru their scans and not stating anything.

    Not that it matters, but if the card was in a top loader or even probably a semi rigid there's no way it was creased in transit. If the plastic bent enough to crease that much you would have easily seen it on the holder.

    In any case, best of luck with the dispute. And thanks for letting us know who was selling the card, so for about the 269th time I can block a seller from my account.

    Don't even bother with Paypal. I hope you paid for it using a credit card. Just send it back to the seller (insured) and notify your credit card company and file a dispute. Take any pictures of it and include the pics with all documentation of the dispute and send it to the credit card company and then ask them to credit your account. The seller will then get pissed off cause you sent him the card back and now he has to resend it back to you and that's a pain in the you know what....... chaz

    When I blow up the auction picture I think I see what you are talking about, but I am not sure. Can you blow up the picture in the auction? If not, send me PM with your email address and I will send you an enlargement (about 300 to 400%). I can't post it here because it is too large.

    I can't blow up the pic from the auction. I tried to copy it and transfer it to my photobucket file but couldn't. I'm just thinking I'll probably be out of the $. I'm just wondering if anyone else here went thru the same thing and lost. And to answer chaz, no the money was from my paypal balance since I had some in there.

    if the seller did not use delivery confirmation, you should just say you never got the card. Much easier to get your money back that way. I don't think you are going to this claim. Sorry

    98.8% is pretty low, I stay away from those 98% people.
    Running an Ebay store sure takes a lot more time than a person would think!

    That is a tough one. I always use my credit card. I've gotten out of a few jams by using the credit card only. chaz

    Eagle... To answer your original question, YES... I've been through this. Chaz is right, Paypal will just be a waste of time. If, and I mean IF you get your money back, it will only be after the sellor admits to sending you a bad card and agrees to refund your money. Paypal is a great service (from certain aspects) but horrific at dealing with issues. Be greatful it was only $19. I've had to get my CC company involved in the past, and that was a hassle too. Granted my dealing with with a slightly larger purchse ($360) it took 6 months to get my money back FROM MY CC Company. I also had to fill out some silly paper-work with my CC company. All in all... it might not be worth it for $19. If you do decide to pursue it, I wish you luck! I can't stand it when sellors do this... I wished there was a better method for rating Ebay sellors.

    EagleEye - Your seller already gave you and everybody else who bought cards from that set good feedback. I'm betting he never looked at the card, and sold it the way he bought it.

    The guy who said he has bad feedback didn't bother looking. Your seller got 7 bad feedbacks in a row, obviously something happened.

    Now that you neg'ed him I wouldn't expect a whole lot of cooperation from him.

    I wouldn't bother with paypal over the $19, too many headaches for not a lot of money.

  • Have to disagree with alluall!!! I dont see a claim here as the card did not list a condition and you did not purchase insurance, which was offered. I had a PSA card appropriated packaged in a bubble mailer that arrived crushed and the card inside was creased. I did not purchase insurance that was offered and I regarded it as my problem and left possitive feedback. You should have done the same, in my opinion.
    My focus, 1970 Topps Baseball Raw and Graded, pre 1989 PSA Hockey and 1933 INDIAN GUM ! Yikes!!

    Ok, thanks for everyone's input. I'll probably just chalk it up as a loss and move on.
    There are too many variables involved with some that I agree with and others I disagree with.
    1) I didn't purchase insurance - Even if I did, it would probably take me forever to recover the money but it also doesn't mean that the seller should send a card in a regular envelope and hope for the best. Flat or regular white envelopes run thru a machine which can cause damage.
    2) I didn't question the condition prior to the auction ending because no condition was stated.....so I guess it's okay for sellers to start selling bent and creased cards and let the buyer beware.
    3) I like the convience of using Paypal because I don't like waiting in line at the post office or supermarket to purchase a money order. If I had paid with a CC and had to go get my $ from my CC company, I wouldn't be able to using Paypal anymore afterwards?
    4) I could of been dishonest and said I never received the card since no del. conf. was used and take the easy way out, but I wanted to give the seller the benefit of doubt to make it better....obviously didn't work.
    5) I agree with Jimq, that no cooperation will ever come from the seller after I neg'd him, but I think it was warranted after the arrogant reply I rec'd from him. Well, I'll just ride it out for as long as I can while his Paypal acct. is being frozened. Thank goodness I didn't pick up anymore of the Clarity /10 cards that he had ending that same day.
  • If anything comes out of this EagleEye, it is the fact that in essence you took one for the team as I'm sure there are a great deal of buyers on these boards that just added that seller to their 'don't buy from' list.

    I know several people have mentioned the lack of purchasing insurance on this auction, but realistically, the guy charged $2.50 for shipping and mailed it for .53 cents in a manilla envelope. Even if you had bought insurance either 1) the card would have probably come in the same condition, whereby you would still have to fight to get your money back. Or 2) there is no proof this seller would actually have insured the card.

    I can't begin to tell you how many sellers on on my 'don't buy from' list just because I got hosed for 1.30 in insurance that was never actually added when shipped by the seller.
    Next MONTH? So he's saying that if he wins, the best-case scenario is that he'll be paying for it two weeks after the auction ends?

    Based on the way the card was shipped, even if you had purchased insurance, the PO wouldn't have allowed your claim anyway. They would rule that the shipper didn't protect the card sufficiently and you wouldn't win anyway.

    Yeah, for $20 I wouldn't bother, because doesn't Paypal still limit the amount of times you can file a claim?

    As stated, seller didn't state condition of the card, so he may or may not have seen the crease. As you know, card companies do produce garbage like this and as collectors, we are unfortunate to pull them straight from the pack this way. Remember, when buying sports cards, buy for the enjoyment and not the investment.

    Okay, update. Looks like I may get my money back after all.
    Got an email from Paypal; and looks like the seller finally gave in, and I'm instructed to send the card back per Paypal's instruction with del. confirmation. All of this could of been avoided if the seller just kindly said to send it back in the first place. Will see in the coming week if he actually refunds once he receives the card back.
