What should I do?

I need some of the excellent advice the members of this board offer.

I purchased a coin on ebay on 10/7/05 for around $33. I paid promptly (which I always do) and the seller left me great feedback saying my coin shipped on 10/8/05. Well, I never recieved the coin. The seller seemed concerned, communicated with me all along, and filed the lost item paperwork with the post office after the 30 days since the shipping date had passed. In our discussion, the seller showed me the address he sent the item to, and it was missing some digits on my unit number. So, the package was addressed incorrectly.

Well, so far, I've heard nothing from the post office. Now, I've requested that the seller refund my money or send me a replacement coin, but he's refusing, citing that I could have purchased insurance on the coin bu t I didn't. I filed an "item not recieved" dispute on ebay, but unfortunately didn't file a dispute with Paypay within the 45 day time frame.

Am I out the $33?? Should I neg the seller (he's got 100% feedback)? Should he refund my money? Am I screwed?

    He made the mistake addressing it incorrectly. He should pay for his mistake. Seems simple to me...Mike

    Actually, I agree.
    If you verify that you emailed him the correct address, and it was HE that incorrectly addressed it, then I would say the onus is on him (insurance or not).
    Also, as has been stated on here, insurance protects the shipper, not the recepient (no matter what some sellers say).

    He would pay or I would neg him (and do it honestly and not with all caps or in a ripping way)

    Also, you may want to check your post office to see if the package is just sitting "undeliverable" and didn't go back to him for some reason.......

    I believe he needs to return the $33 or help you find the coin (if possible). No matter what the auction descriptions claim, insurance protects the seller, not the buyer.

    Why would he fill out lost package paperwork with the post office if insurance wasn't purchased?

    There's absolutely nothing the post office would do (nor, should they) and I seriously doubt they would even accept the paperwork for non-insured packages.
