"multiple copies of the same coin"-same photograph...

so I'm really trying to find a nice Franky where I stumble on this auction page.
1963 ms65 pcgs
please notice the three coins that say "very nice coin" in white at the lower right of the holder.
I asked the seller why he has the same photo for three different auctions? his reply:
The picture is the same and I have mutiple copies of the same coin
should I be a smacked a@@ and tell him it's not legal to sell copies?!
more importantly, each coin is unique. just because they grade the same way doesn't make them carbon copies of each other. Should I subtly point this out to him, or is it not worth it and just move on?
