selling tickets on ebay?

i have 4 tickets to falcons game sunday cant go face value is 59$ i see them on ebay all the time? Is this legal to sell on ebay? or is it scalping?

Some states, like Illinois, limit the amount you can sell the tickets to face value. EBay asks for face value and there is a disclaimer that anything over $300 face value may need to show proof. I have heard from "a friend" that if you set the face value to $295 you can sell your tix for upt to that and still make some money. If you live in a state that has these laws, you are rolling the dice by going over face though.
