Advice on Ebay matter

Hi there I am wondering if anyone has some advice on how to proceed with an Ebay problem I am having. I ordered a 1960 PSA 7 Brooks Robinson card through ebay, and payed through paypal. I received the card and it is completely broken through the middle of the holder. It in fact broke totally in half, and the card now has a major crease through it.
What really irks me is this card came in a plain manila envelope, without bubble wrap. The card itself was wrapped with one layer of newspaper. I contacted the seller, and he is stating"the shipping a'int my fault, ask your postal service"
It was not sent insured, and at $40 it isn't the end of the world to me, but I have requested a refund of my paypal account. He responds that if i intend to file a claim(not sure what this means) i had better send him the remnants of the card back or he will report me to Ebay.(for what I am not sure)
How would you proceed at this point? Let it slide? Go through paypal? Give him a negative-given his attitude I am sure he would respond with retaliatory neg.
I apprecaite any thoughts.

Photograph the card and damage for proof. Go to your local Post Office and file a claim. They are still responsible whether it is insured or not( per a supervisor friend of mine at the local PO). Then send the worthless card back to the seller. Up to you on the Paypal part . I think paypal will side with the seller as you did not pay for insurance. As in all of my auctions----Insurance is reccomend, but optional. On high dollar items insurance will be included in the shipping.
As for the Paypal part, unless you bought insurance from the PO or buyers protection from them, you are out the money.

the seller should reimburse because his packing was total inept! sellers like this are just plain stupid and show no regard for their customers....he deserves a negative for being a cheap dumb-ass.

Is anyone else at all amazed by the concept that you pay someone to do a job for you, but then have to pay them extra to do it right?

I had a similar case 5 yrs ago where the card was advertised as MINT but came over as FR/GD. He refused to reimburse so I took the claim route with eBay. Ebay will charge a $25 processing fee (so in your case you are chasing after 40 - 25 = 15). Not sure about the protection offered by paypal.
For my case, I got someone who is familiar with the card (such as your local store owner) to write a letter stating the condition of the goods. Ebay sided with me and gave me back my $$ (minus $25). Ebay kept the goods instead.
Your best bet is to claim goods received not as advertised (instead of shipping damage since there is a possibility the case can be broken before shipping). That may be too late with all the email correspondances you have had so far. I don't think eBay will pay anything. In fact, eBay purchase protection states "items damaged or lost in shipping" is not eligible. For paypal, theor website states protection against "non-receipt" which your case doesn't apply.
As for shipping the card back to the seller, I would consult with ebay first to make sure that is the protocol.

Or better yet.....do the above and then when I do mess it up, say please fill out this form, with proof it was wrong, send it to someone for them to verify it, then bring it back, then we'll send it in to our processing center and you should receive your refund in about 8-10 weeks.
