Acowa I hear what you're saying, but, as stated in the other thread, it isn't about a couple of bucks - it's about someone blatantly rewriting the implicit terms of a contract. I think Perry is inviting this fellow to defend himself if possible and I, for one, would be interested in how he might justify his action.

i really just want him to explain how he feels he can automatically take charge of an auction and start giving out demands, regardless of the original terms of the auction..

What if the "dude" bought a $3000 card from you, which you required him to purchase the correct amount of insurance from you and pulled the same thing? It would be a big deal then. The argument of well $3000 compared to $47 doesn't hold water if the discussion is on the "principle" of the discussion, which is what I believe it is. It is obvious that the "dude" has a problem with shipping charges as witnessed by his feedback given, but he is trying to take the law into his own hands. It is time to shut him down as much as possible.
Did anybody report him to report him to ebay? I'm sure they would have something to say regarding the fact that he doesn't comply with the terms of the auction, then leaves negatives for sellers who don't comply with his ridiculous demands.
Just wanted to let everyone know this joker is still up to these same antics sold a card and receivged this same note and a tore up bubblemailer from him today. I responded with this
"I received your payment today. I do not accept SASE's it puts the card at risk. I ship in brand new bubble mailers it protects the card better, has less chance of tearing and protects me as a seller. Not to mention the envelope you enclosed has been used multiple times and is a mess. Either I receive the $3 for shipping or I will tear up the check and relist the card for sale. If you cannot follow my terms I'd rather not sell to you. "

I think he's come out of hiding on these boards, too, lately. That's just flat out lame.
Collecting 1970s Topps baseball wax, rack and cello packs, as well as PCGS graded Half Cents, Large Cents, Two Cent pieces and Three Cent Silver pieces.
I really don't see the big problem with him---all he asks you to do is put the card in, not taking any extra time to package it up, you just put the card in and drop it in the mailbox. I would have absolutely no problem doing that.

So what? If he recieves the card damaged, his instructions leave you with no accountability whatsoever. Personally, I might drop a note in or reuse a different bubble mailer (I normally throw them away), but no one is forcing you to take any extra time with it.

Isn't it Paypal that requires d/c with all transactions? The instructions, if kept, should be sufficient for eBay. I also wonder if there is any evidence of the buyer doing this (trying to get his money back due to damage) with any of his purchases?

I'm not saying a buyer should change the terms but if you are still getting the same amount of money for the card with less work and risk (no paypal) then I don't see the point in making a scene over it. The money spends the same and if the joker paid more than the next guy then it will go further. Block all these guys and send 'em to me. Perhaps card sales are faltering on eBay because sellers are getting too costly and picky.... Principle? NO! Principal? No! Principle? NO! Princi....we could go back and forth for ever, but the point is - this is ebay. It's been around for years. People should know the deal by now. This is blind commerce: I don't see you, you don't see me, we send money half way around the world and we send cards the same way - it's called following instructions. When somebody rewrites the way I choose to do my business, I smell trouble. This guy is wrong wrong wrong. I would remind him that the rules of ebay require the seller is responsible for getting the item safely into the buyer's hands. That doesn't mean cheapening my method of shipping and handling without my expressed agreement BEFOREhand. Would I get in his face about it? No. Would I politely let him know that society has rules for a reason - probably. Would I hold his check until the cows came home? You betcha.

I understand your point with regards to making buyers jump through hoops and I agree that some sellers go to the extremes where I believe it has to discourage some potential bidders. However, clearly stating your shipping (and handling, if applicable) charge and expecting bidders to comply with it by virtue of their bid(s) is hardly an example of this sort of practice. You don't have to be on eBay for very long to learn about the "evils" of shipping and handling charges... you weigh it into the price you are willing to pay and bid accordingly or hit the back button. What you do NOT do is decide to change the terms you agreed to when bidding as this bidder has (or at least has tried to).
That said, the seller is absolutely right in principle, but I think the best advice is those who suggest sending the item out per his wishes, not leaving feedback (at least not first), and blocking the bidder. They did pay for the auction, so you are only out the shipping, and the potential hassle / negative feedback is just not worth it in the grand scheme of things probably. My experience has been that people who make demands like this, with no regard for auction terms and conditions, tend to be generally unreasonable, petty, and vindictive. Precisely why I too will be adding them to my blocked bidder list.
What makes you think they are the same person pandrews? Whoever it is needs to get out of the hobby. The endless nickel-and-diming of people really bugs the hell out of me.
