Updated Forum Terms and Conditions

We have made a few revisions to the terms of usage for these forums. Please take time to read them. By continuing to post on these boards after this post, you are agreeing to these terms.
If you feel you can not abide by any of these terms, please advise me and I will terminate your account.

Welcome to the Collectors Universe, Inc. ("we") message boards ("Forums"). To post messages on these Forums, you must register as a member. This registration is free of charge. Please review the following Terms of Membership ("Terms") carefully. By registering, you agree to abide by these Terms. If you do not agree with these Terms, please do not register to use our Forums. We may change these Terms from time to time. If we make any material changes to these Terms, we will post the new Terms along with a notice of the changes.

Registration

When you register, you must choose a unique user name or "handle" and you must provide a unique, valid email address. Duplicate user names and email addresses are not allowed, so if the name or address you enter is already in use, you will be prompted to choose another one. In addition, you may not choose a handle that might mislead other members or infringe on any trademark, right of publicity or other rights.

To prevent any member from using another's handle, each member's account is password protected with email verification. When you register, a randomly generated password will be sent to the email address you provide. Once you have received your password, you may edit your profile to change your password to one of your choice. You may also change the email address in your profile. HOWEVER, if you do, a new, randomly generated password will be sent to that address. Entering an invalid email address will cause your user name to become unusable by anyone, INCLUDING YOURSELF, until the information in your account is manually corrected by a moderator or administrator.

Although we intend to be as inclusive as possible, in certain cases we may not permit users to register for these Forums, at our own discretion and for any reason. For example, we may need to bar registration by users with email addresses from a specific email service or ISP.

Your Account

You agree that, as the holder of your membership account, you are entirely responsible for activities conducted through your account. If you authorize a minor to use your account, YOU ACKNOWLEDGE THAT SOME AREAS OF THESE FORUMS MAY CONTAIN MATERIAL THAT IS INAPPROPRIATE FOR MINORS. These Forums are not intended for use by minors. We may terminate your membership in these Forums at any time and for any reason. For example, if you violate these Terms, we will have the right to terminate your membership and permanently ban you from using these Forums.

License to Use Posted Materials; Monitoring

Subject to the Posting Rules set forth below, by submitting messages, information, data, text, files, links, artwork, photographs, software, or other materials ("Materials") to any of these Forums, you automatically grant (or warrant that the owner of such Materials has expressly granted) us the royalty-free, perpetual, irrevocable, non-exclusive, worldwide right and license to use, reproduce, modify, adapt, publish, translate, take excerpts from, incorporate into other works, create derivative works from, distribute, perform and display such Materials (in whole or part), in any form, media, or technology now known or later developed.

Any message posted on our Forums expresses only the views of the author of the message and does not necessarily reflect the views of these Forums or any person or entity associated with them. Although these Forums use moderators and administrators from time to time to monitor the Materials posted in our Forums for compliance with these Terms, we cannot and do not pre-screen or monitor all such Materials. Therefore, you agree that neither these Forums, nor any person or entity associated with them, will be held responsible for the contents, accuracy, completeness or validity of any Materials posted in them. We shall decide which areas of the Forums to monitor in our sole discretion.

Posting Rules and General Rules of Conduct

You agree that you will not use or allow others to use your membership in these Forums to:

1. Post or transmit any Materials, or links to any Materials, which are knowingly false and/or defamatory, libelous, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented or threatening, which violate the right of privacy or any other right of any person or entity, or which intentionally or unintentionally violate any local, state, federal or international law or regulation.
2. Post or transmit any Materials, or links to any Materials, that infringe any patent, trademark, trade secret, copyright, right of publicity or other proprietary rights of any party. You may not post or transmit Materials that are not created or owned by you unless you have previously obtained permission from the owner thereof to post and transmit such Materials in the Forums and to license such Materials to us as set forth above.
3. Post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation in the Forums (except in those Forums that are designated for buying and selling items, provided such advertising or other solicitation directly relates to such items). You will not post or transmit any chain letters, pyramid schemes or similar schemes in any Forums.
4. Impersonate any person, or falsely state or otherwise misrepresent your affiliation with a person or entity.
5. Post or transmit any file that contains viruses, corrupted files, "Trojan Horses", or any other contaminating or destructive features that may damage someone else's computer.

The following rules of conduct are intended to make the experience of using our Forums more informative and enjoyable for all of our users:

1. As a general rule of conduct on the Forums, before posting a message on the Forums, you should ask yourself if the message is something that you would say to someone if you were speaking to them in person. In other words, you should be polite, treat others with respect, and avoid taking a confrontational or belligerent tone.
2. You may disagree with an opinion expressed in a Forum, but refrain from attacking or disparaging (i.e. "flaming") the person who posted it.
3. As well as you can, please format your posts in standard English, using capital and lowercase letters in the traditional manner.
4. All posted Materials must directly relate to the topic of the Forum in which such Materials are posted.
5. You may not "spam" a Forum by posting the same message or other Materials on multiple occasions on the same day.

Removal of Materials

We have the right, but not the obligation, to edit and/or remove messages or other Materials that violate these Terms or that we otherwise consider objectionable or a breach of posting protocol at any time. Any user who believes that a posted message is objectionable is encouraged to contact us immediately by email at info@collectors.com. Upon receipt of such notification, we will make every effort to take such action as we deem necessary and appropriate within a reasonable period of time. However, we have no obligation to respond to any such notification or edit or remove any particular Materials, and we cannot guarantee that any action will be taken as a result of your notification. We reserve the right to edit or delete any message for any reason whatsoever, at any time and at our sole discretion.

Your Responsibility

You agree that you are solely responsible and entirely liable for the content of your messages and other postings, and you will indemnify and hold harmless Collector's Universe, Inc., e-Zone Media (the software manufacturer) and their respective subsidiary, parent and affiliated companies, officers, directors, agents and employees with respect to any claim arising in connection with your activity on these Forums, including but not limited to the appearance and/or transmission of your messages or other postings.

Privacy

Notwithstanding anything to the contrary in our Privacy Policy, we reserve the right to disclose your identity, your postings and any other information we may know about you in the event of any complaint or legal action arising from any Materials posted by you, or in the event we believe such disclosure is necessary to comply with any law, legal process or government order, to protect and defend our rights or property or enforce these Terms, or to protect the personal safety of other members of these Forums or the public.

The information and other Materials you post or transmit on the Forums may be viewed by any Forum visitors. Please do not post any private information unless you want it to be available publicly. Never assume that you are completely anonymous and cannot be identified by your posts.

Disclaimer

You agree that your use of and reliance on the Forums and any Materials contained thereon (including any purchases or sales of collectibles you make through the Forums) is at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and noninfringement.

Information or other Materials obtained in these Forums are no substitute for independent research, and you should not trade collectibles or make any purchase or other decisions based solely or largely on information obtained in these Forums. We cannot be responsible for the content or accuracy of any such information or other Materials, and shall not be responsible for any such decisions made based on such Materials.

The collectibles market is volatile and thinly capitalized. Significant short-term price swings are always possible. In addition, the difference between dealer buying prices often can be large. Collectors Universe, Inc. and its principals, employees and representatives do not guarantee a profit or guarantee against a loss, for any item you buy or sell through any Forum or based on any information or other Materials contained on any Forum. Collectors Universe and its principals and representatives do not guarantee the performance of any Collectors Universe authorized dealer.
