Off Topic - PayPal buyer's protection for non-cards

I was just invovled in an ebay transaction for an electronics device that does not function properly. The item was described as "like new" and "only used 5 times". Never did it say anything about it funcitioning properly or not. The item also has pockets of dust in certain areas indicating it has been used a little too much to be considered "like new".

The seller refused to issue a refund, so I filed a claim with PayPal. Anyone have similar experiences? How did they turn out? Looking at the auction, it never says the item is "working". But is that too much too assume based on it being described as "like new"? The "like new" might only cover the physical condition in PayPal's eyes.

Who do you think PayPal will side with?

    did you claim you didn't get it? If so and he put delivery confirmation on it, then you aren't going to get your money back. I don't know about issues with the product not being as described.
    Running an Ebay store sure takes a lot more time than a person would think!

    Did you pay with a credit card? If you, get in touch with your credit card and they should be of some help. If not, you're at the mercy of the incompetent boobs at Paypal. Good luck!
