Paypal dispute. Help me! :(

So I've waited for over a month now for them to start the dispute process and I get an email today from Paypal saying that they want a third party to say the fake item I purchased is indeed a fake. Do I really have to send it in to PSA and spend 30 dollars or however much its going to cost me just to get my money back? The only other options I see is getting some sort of invoice or something that is #'d(asked for by paypal)from my local card dealer saying its fake. Though I don't know if that would work. Beyond that I guess my only option is sending it off to PSA and losing the money for the grading. If anyone has any advice for me or other options, they would be truely appriciated.

PS. If anyone remembers and is curious, the card in question was a 86 fleer Jordan rookie(there was a fairly large thread about it a month+ ago). The seller has 100% possitive feedback(I haven't even neg'ed him yet in hopes he would just give me the refund, but I guess thats out the door), over 300 sales I think. He purchased a fake (listed as a reprint) 1 month prior. But for some reason paypal doesn't think that and some high res photos of the fake and a real card are enough proof.

    Paypal are not card experts, so sending them a scanned photo of the cards is not going to help.

    Call them up and ask them if a official letter from a card dealer is sufficient evidence that it is a fake. Asking them directly is the best.

    $30 for grading the Jordan fake should be your secondary option. If the first option does not work, move quickly and just bite the bullet--pay PSA. I know its a hassle, but you just have to cut your losses at this point.

    Even if you went through your credit card company to over ride Paypal, they would also want some third party to evaluate the card's authenticity.

    If a seller knowingly sells a fake, I don't think they can be trusted to issue a refund. What this seller did is very offensive. He does not have a leg to stand on.

    If you can, I think you have a clear case to sue him in small claims court. It would be slam dunk for you. Also, this ought to teach him a lesson too. Hope that helps.

    Hopefully you paid by credit card. If you did, go right to your credit card company and bypass Paypal. Your credit card company will force Paypal to at least contact this jerk to get a response out of him.

    If this is over a month, it's past the paypal 'window' anyway and they will bow out of the matter.

    First, contact your credit card company and initiate an immediate refund.

    Then you will have to state the reasons for wanting the refund and return the card vis certified mail. What is the return policy for the seller? That's very important but not the final word either. If you have saved email from the seller, include that in your request for the refund with your credit card company.

    At this point the seller is worthless to you - let them be surprised by the refund! And watch the fur fly! Some sellers get nasty when they are forced to return money.

    Right now, I'm tired of buying anything - there's nothing worse than getting something in the mail that is totally misrepresented!

    THis guy had a 100% feedback with over 300 transactions. I would have never guessed he could turn like that.

    Stone is right, you only have 30 day window to dispute with paypal. I think if you already declared a dispute with them within the 30 day window, the supporting documents could come later. Otherwise, Stone is right. Just get on the phone with your credit card company immediately and request a charge back. Tell them the Jordan rookie was not advertised as a fake or reprint so it was misrepresented. Then ask them if a letter from a dealer would suffice to confirm its authenticity. Any corresponding emails should be sent to show you tried to contact the seller.

    I have done chargebacks before and the fur did fly! It makes it kind of sweet to know you have some recourse. It's not your fault, the guy tried to shaft you, so you have to take action.

    As of January, the Paypal window is now 45 days.
  • What I meant by its been a month+ is I filed the dispute a month+ ago and they just now got back to emailing me saying they need some sort of evidence that it's fake. Sorry for the confusion on that part. And yes I paid with paypal but with my CC, so I guess I have that option. The only thing holding me back from doing that was the fact that if I do, doesnt paypal not like that? I heard they'll freeze your account etc etc. And Mike, the seller didn't have a return policy. I remember me and you talked about this and you said just because of that fact he "had" to take the card back. I didn't want to try that either because he hadn't been responding to any emails I was sending him(this was about 2 months ago). Thanks for the advice everyone, I appriciate it. I think what I'm going to do is get ahold of paypal, see if they will take a letter from my local card dealer. If not, I will call my CC and see if they will. My last option will of course to send it to PSA and lose whatever money I have to pay them. Thanks again,

  • I wouldn't contact paypal... Just get a letter from your local card shop and fax it to paypal. Don't give PAYPAL a chance to say no! They already told you to get a 3rd party and they didn't save where to get it from.

    I remember our conversations - was just bringing it out for the purpose of others - as I have said - if you pay via Paypal, you have to give them first shot - that's actually an implicit contract one makes with them for using their service - I remember one person who went around it got stung by them since the charge back was disputed by the seller even tho the credit card company had a mind of it's own.

    I agree with DS, get a dealer to attest to the fact that the card is fake and give it to paypal. If paypal gives you a final no go, then work thru your credit card company to get your money back.

    I have confidence that in the end you will prevail. I'm sorry for all the grief you have gone thru. Hell, I have been beat for big bucks on occasion myself and it never feels good!
