Preparing For the Worst

Hey Guys
Preparing for my first possible scam. A few days ago I win a 55 Topps Killebrew PSA 5. The package arrived today and lo and behold I got a 56 Topps Killebrew PSA 3. Let me say that I don't really think I'm being scammed since he actually did send me something. The guy has perfect feedback, left me positive feedback right after I paid and also sent me an e-mail thanking me for payment and to let me know that my card was on the way. But I figure I'd start getting things in order just in case. I paid with paypal via a credit card. Will Paypal/my CC company give me my money back if this guy doesn't respond to my e-mails? Sorry if this is a dumb question but this is potentially the first time I've had to deal with this.

Any advice is appreciated. Thanks.

Scott

The item is signifigantly different so PayPal should cover you.
  • I can tell you that if you talk to him and he decides to not refund/send you the right thing, I'd go through your CC first. From what I hear that pisses off paypal but I had a similar situation happen to me recently. Was sold a fake/reprinted card and I decided to go through paypal to let them handle it. Its now a month+ later and they are still "reviewing" the case. Your CC will probably handle it alot quicker, atleast from what Im told. Hope this helps and good luck image

  • Going through your CC company first could result in your Paypal account being frozen. Part of the users agreement says you are suppoused to attempt to reslove the issue with Paypal first. That being said I would contact the seller first, then if nothing file a not as described case with Paypal and see how they rule then go to the next step. You have 45 days with Paypal and I have heard of chargebacks on CCs occuring up to 6 months after the fact.

Did the seller have an auction ending for a '56 Killebrew at about the same time? If so, probably just an honest mistake.
  • First things first. Email the seller and explain the problem. He could have accidently sent the wrong card. Its happened to me a couple of times. Sometimes, mistakes happen

I just got a 2-month wrong-card-sent fiasco resolved. But everything's cool. If the seller's track record is any indication, you'll be OK as long as whoever he sent the other card to plays ball, assuming that's what happened.

I've heard Paypal has changed their ways, but I wouldn't rely on them to get involved in a PSA 3/PSA 5 dispute. I got scammed by a guy who auctioned off a PSA 8 card but sent me a beater raw card. Paypal's position 3 years ago was that they don't get involved in disputes over "condition," which was all the problem was to them. The fact that he sold me a serial-numbered item in a slab in addition to there being a vast difference in condition was immaterial. When I filed an ebay fraud charge, he repaid me. So I've not got a lot of confidence in Paypal. Maybe your CC company will be better. But I'd give it a little time.

I got an e-mail from him this morning apologizing and offering to refund my cost for sending the card back to him. I think the guy is on the up and up. I do appreciate all the advice though. Thnaks fellas.

I had that happened with one of the most popular and respected dealers. Honest mistake which I have to check and double-check every card I package up since it is easy pick up the wrong one or get the receipts mixed up.
  • Same thing happened to me before. I won a PSA 10 and was sent a PSA 9 of the same card. But both were up for auction and he sent me the wrong one. It was a reputable dealer that I had done business with before.

My current issue is with a buyer who hasnt paid after 6 weeks. I sent for the fee refund and he now says he will pay overnight. We will see. If not, it will probably be the first negative Ive ever sent.
