Hello Michael,
Thank you for your email to Bill Cobb. Bill has requested that I respond
on his behalf.
I can understand your frustration in this matter, but what you are
describing is something that you will need to report to law enforcement
to investigate. eBay is only able to investigate issues on our site,
and sellers that post items on eBay are responsible for those
transactions. Additionally, there are many businesses that utilize
eBay, as well as the isolated individual, and many businesses do have a
billing office that handles payment processing. This is not a violation
of our site policies nor something that we are able to investigate.
Therefore, I strongly recommend that you contact law enforcement
regarding this specific issue.
eBay is very concerned about potentially infringing items being listed
on eBay and have developed a number of specific policies to address
these issues. Our Community Watch team actively reviews listings that
are brought to our attention. Since we are not authenticate items that
are listed on eBay, we also work with over 10,000 companies who are
concerned about how their intellectual property is possibly being
abused. Since we are not experts on the items listed on eBay, we
sometimes will referral listings to rights owners if we have not found
sufficient evidence of a violation of one of our policies. We would
encourage you to also consider contacting specific rights owners with
your concerns. A number of these rights owners have even created an
About Me page on eBay so that you can contact them more easily. For a
list of About Me pages of VeRO members, please visit the following link:
http://pages.ebay.com/help/community/vero-aboutme.html
We also appreciate it when members contact our Community Watch team
directly about listings for potentially questionable and infringing
items. A list of these policies is located at the following URL:
http://pages.ebay.com/help/sell/item_allowed.html
Please understand that for privacy reasons, are Community Watch team is
not able to reply back regarding any actions that have been taken, but
we will review the listings you report to us.
I am also concerned regarding fraudulent activity, however, in order for
me to investigate this type of activity, members have to report this via
our online dispute resolution service. This service was recently
revised and released mid-January 2005, so it is easier for buyers to
report incidents where they receive an item that is significantly
different from what is described in a listing or they simply do not
receive an item that they paid for.
This service allows both our buyers and sellers to workout their
solutions in an amicable manner while at the same time officially
documenting this type of issue on eBay. If you are not able to resolve
your dispute with your trading partner, you can also escalate this claim
to an eBay claims adjustor who can evaluate the claim for possible
reimbursement under our Standard Protection Program. To learn more
about this program:
1. click 'Help' found at the top of our web pages
2. click 'Transaction Problems'
3. click 'Protection for Buyers'
4. Click on 'Item Not Received or Significantly Not as Described
Process'
Some key things to keep in mind about this program, you cannot file the
online dispute until after 10 days has elapsed from the listing ending
date and you must file this prior to the 60th day from the listing end
date in order to be able to escalate this online dispute to our Claims
Adjustor. Once the online dispute is opened, the dispute has to be open
for at least 10 days to allow your trading partner ample time to respond
to the dispute. However, if you are needing to escalate the claim, it
must be done prior to the 90th day from the listing end date.
From the above web page you can click on 'Buyer Protection: Step by
Step' under the Related Help topics at the bottom of the page to learn
more about the new Buyer Protection Program. These revisions will make
it easier for you to use this process and allow you to track the
progress of this online.
I have investigated the issue regarding seller 'brokenbeltloop' and have
taken appropriate action. Such action may include issuing a warning, a
temporary suspension, an indefinite suspension or terminating the
membership. Keep in mind that eBay uses a number of factors to determine
when to take action. These factors include reports filed by eBay
members, the seller's feedback score, and reports received from law
enforcement agencies. Due to privacy concerns, we cannot discuss the
details of any action taken. I hope you understand our policy and that
it assures you that your personal account history will always remain
private.
My review of listing 3959465818 doe indicate that you are not the
winning bidder in this listing, however it was ended with a winning
bidder 'kahililani'. If this buyer has a problem with this specific
transaction then they will need to complete the online dispute
resolution process that I described above.
Your efforts and assistance are invaluable. To further assist us in
these efforts you can proactively report these items, concerns, etc.
through our web form. Our webform can be found by clicking on 'Help' at
the top of most eBay's web pages. From here you click on 'Contact Us'
found on the left side of the screen towards the top. You will be
presented with three boxes where you can select the appropriate items
that describe your specific concern. Once selected you will click on
'Continue' found at the bottom of the page. On the next web page, click
on 'Email' which will bring up the web form so that you can submit your
additional concerns to us.
Thank you for taking the time to submit your concerns to me.
Kind regards,

Dear Bill,
I ran into the same situation again this evening that I have
contacted you and the other departments at Ebay and Paypal
about numerous times. I was looking to buy Washington rare
quarters again this evening, and stumbled upon another
instance of fraudulent activity. The item in question this
time was a "1932-S Washington Quarter 25c MS64 KEY DATE"
Item number: 3959465818.
I emailed the seller of record (brokenbeltloop) and found
out that this item again belongs to the ficticious "Ryan
Taylor." Please understand that the Ebay sellers of record
and the people accepting Paypal payments and depositing this
money are every bit as defrauded as the buyers who don't
receive their merchandise. I am not sure anyone appreciates
the gravity of the situation.
Personally, I take this to heart because people like me who
buy and sell are going to have a much tougher road ahead if
this type of activity continues.
PLEASE CONTACT ANY OF THE PEOPLE COPIED IN THIS EMAIL AS ALL
ARE INVOLVED and HAVE BEEN VICTIMIZED ! I was asked by the
seller involved in my transaction not to contact him, but
masta_1 is also a victim !!!
If you need further elaboration on what the propblem is,
please contact me at (609)-280-8200. OR contact the others
by email - i.e. copied above. I believe there must be many
many others who are involved in the same situation !!!
I really fear for the future of Ebay if nothing will be done
about this. Please understand that I am not only a buyer
and a seller, but also a stockholder.
PLEASE !!!!!
Anything you will do would be appreciated,
Michael D. Tweed

Translation....
We are not going to really do anything about it but this will make you feel better.
This is one of the many reason I no longer buy on ebay unless it is a low end [sub $200] item and even then the sller better have lots of feedback.
e Bay needs some competition....
