Isn't this impersonation of the real PCGS slightly unlawful?

PCGS certified coins

Excuse me, but isn't this just slightly unlawful? The seller is using the PCGS Name, shows no pictures and has a 100% positive rating however you do not catch this impersonation unless you happen to read the item description. Check this out. HRH, if you're monitoring your Baby, the US Coin Forum, what do you think about this impersonation/ identity theft?image

Editted to now say...

Well to first time lookers, everything is now normal but this morning the word Professional was written as Pneumismatic. I asked who this Pneumismatic Coin Grading Company was and he replied......

It is Professional. Sorry about that. I had a brain
seizure & you're right, I don't think there is a
Pneumismatic Coin Grading Service, at least not that
I've ever heard of... until now that is. Hmmm maybe we
should start one??? thanks again, Mike

Unlawful to perhaps make a mistake image Looks like he has sold a lot of raw stuff and may not be familiar with the name to me. I didn't see a single other occurrence of him selling slabbed coins in his feedback (though I didn't check every one).

  • Well, it may be a coincindence but all his other auctions have black easy to read descriptions on this one the green and lettering almost makes me sick reading it ... As if he hopes someone won't read the fine print ..

Maybe I'm missing something, but it looks like nothing more than a spelling error. What makes you think they are not PCGS slabbed?

Isn't it possible that they don't know what PCGS stands for and just thought of something?

I think the guy is just confused over the initials. The PCGS slabbs do not have the name spelled out they only put PCGS on them. I sent him an email asking if they were really graded by the Pneumismatic Coin Grading Service or the Professional Coin Grading Service. We'll see how he responds.

Where the real problem lies would be if an individual is using the acronym, PCGS, on his or her holders on coins being offered for sale. One could label and sell his or her coins as being graded by the"Pneumismatic Coin Grading Service" all day, no problem.

A legal question to answer is, roughly:

Is the defendant attempting to mislead consumers by capitalizing on the PCGS (Professional Coin Grading Service) name?

The guy may be from the back woods. I think he just can't spell and has no idea what PCGS really stood for. And pneumismatic is not a far cry from numismatic for someone who has a mechanical background but not a lick of book knowledge. But then again, getting that "pneu" part right for an air system is quite a challenge for anyone. I'll bet he's above board. At least he has 100% FB so far.

Here is my email to the guy and his response. It was just a mistake.

    My question:
<<"Your listing says the coin is slabbed by PCGS. In the description you say it is slabbed by the Pneumismatic Coin Grading Service. PCGS normally stands for Professional Coin Grading Service. So are your coins graded by the Pneumismatic coin Grading service or the Professional Coin grading Service?">>

    His response:
<<Professional, sorry for my mistake, thanks for bringing it to my attention. Certification #s and all. Sorry I do not have a digital camera or flatbed scanner to provide a picture.>>

My favorite is "Personal Coin Grading Service". You tell us what grade you want and we'll see that you get it. image

Well, I very politely asked him,

"Just who exactly is this Pneumismatic Coin Grading Service? I don't believe I have ever heard of them. Thanks."

    pittbreeder

Actually, he had to be quite diligent to reply having failed several times to make it past all the Security and Spam Blockers.
Nonetheless, he DID finally succeed and here is his emailed reply.

OK! image I didn't respond in any fashion, but if he says so............! I believe he has since ammended his description.image Brain seizure? He gets everything else correct.... ALL but the MOST CRITICAL WORD. Misspelling, C'mon Gimme a break! All I CAN say is other than this he SEEMS to be OK with 100% positive feedback rating. VERY WEIRD INDEED!!

Maybe it was similar to a Freudian slip and he use "Pneumismatic" because he was thinking of NGC (NUMismatic Grading Service)!imageimage

Give the guy a friggin' break. You ever made a mistake? I'm all for pointing out the potential scams, but to call out every seller who may not be as "smart" as you is a bit much.
"What are you putting that tape on your nose for?"
    "Exactly."
