Should I Ask For A Refund?

Ok I bought a box of 1989 Fleer baseball waxbox which I thought contained "error" cards from that run.

Well on the 3rd pack I opend, I pulled the corrected version of the Billy Ripken FF card...black box.
Obviously, this is not an error version waxbox.
But then again I re-read the auction description, and all it really says is chance of pulling a "variation" of the Billy Ripken card...so maybe I shouldn't ask for a refund, because the black box version is technically a variation.
