What would ebay do in this situation?

I use a "buy it now" on an item. Come back to my computer 2 hours later and I have a email from the seller stating that he relisted the item because it was an incorrect price. I go out to ebay, and see the item is already resold!!! AND the "buy it now" price is one that I would have paid!

Who's coin is this? If for some reason he states that I can have it, does he have to stick to the orignal price?

  • My gut feeling is you should have the coin. A contract is a two way street imho. No if were talking huge $ difference that may be another story but it does not sound like it from your description. If so a good dealer should eat it.

    The buy it now difference is really small, only $18. Its more of a principal issue then a cash one. Its not a dealer tho, private party. I just cannot believe he would relist it without contacting me before hand.....
  • I'd say it's yours at the original BIN. I hit a BIN on a coin that had been listed less than 3 minutes (I got lucky!), the seller made an obvious mistake on the BIN (way too low), but was willing to stick by it. I felt sorry for him, and paid him the middle of his BIN price and what the coin was really worth. I got a good deal, he was somewhat "saved", and we both felt OK about the whole thing. But, he originally was willing to swallow his error, so I felt it was the way to go for me.

    In your case, the relisting of the coin bothers me! It should be yours at the original BIN.

    If the Bin was a mistake and the seller emailed the buyer explaining the situation that should take care of it.
    I know of the auction you are talking about. I saw the new bin price and the explanation in the auction of why the coin was relisted. He even said the first auction was a "bin" mistake, that's why it was relisted.

    <<I relisted this item due to a typo. The first listing had a buy it now price of 27.00. I meant to type in 57.00. That is all my fault. For that reason, I lowered the buy it now to 45.00. The list on this coin in VG shape is 73.00 so this is a good buy.>>

    The seller is pretty new on Ebay, seems truthfull. I wonder if you would have replied to his email sooner you might have been able to negotiate on a price. I really see no reason to Neg the seller ,I'm sure he will neg you back.

    Like I mentioned in different threads. I have Bin'd forum members auctions for 99 cents on coins that where worth hundreds. There was no way I was going to hold them to that price.

    The coin is yours and the seller breached his contract with you to deliver it at the that price.

    However, you don't have any way of enforcing it.

    The only satisfaction you can get is leaving him negative feedback - but you could get one back.

    He should have at least given me a chance to buy it again, instead of relisting and then sending me an email afterwards! I wanted the coin, even at the new price! I'm going to contact ebay tomorrow about it.
  • I agree with Trooper - give the guy a decent break! Hey Relayer (AKA hardcore) - you ever made a mistake? I am a true free market guy, but I also have compassion for my fellow man. These are not necessarily mutually exclusive concepts!

    I made a mistake on e-bay recently... bid for a bust half thinking it was a bust dime. Based my bid on the much higher dime price. I came back and looked at the auction a couple hours later, saw it was a half not dime and realized my mistake. It was within 12 hours of auction close. I e-mailed the seller, explained me error, and said I'm looking for a smooth way out. He e-mailed back e-bays rules for retracting a bid, and said don't even ask for him to cancel my bid.

    Worse yet, the under bidder wanted the coin and bid me up to near my maximum, about $50 above the coin's sheet value of $80. So I won, I e-mailed the seller again to see if he would offer it to the under bidder and I'd cover the shipping. He said no... my error so my responsibility. Anyhow, I've mailed a check and will get the coin. The seller has a no questions asked return policy....

  • I did this one time when listing an item. I used a duplicate listing and forgot to change the BIN. So instead of $600 it was $120 or so.. yea. Ofcourse someone pounced on it the second it was listed. I told the person right away that it was an error, he pursued it and eBay called me about selling items. Anyway I relisted it correctly and sold it, not to the same guy ofcourse. Oh and I blacklisted him because he was a braying ass via email.

    Legally it's your's because your bid is a contract to buy and the seller could be reported as a deadbeat seller. What would happen to you if you bought something then refused to pay for it? image

  • IMHO .. The right thing would have been for the seller to give you first right of refusal on his upped BIN.

    But since he didn't on a coin of this price there will probably be many more opprortunities on a similar coin

    No big deal ... Move on ...
  • It's your coin sort of, but not worth the fight. The seller should have just stated it was a mislisting typo and withdrawn the coin permanently. A contact really isn't even binding IMHO because a clear mistake was involved. Note how a lot of real dealers have a typograhical disclaimer written by lawyers at the bottem of their pages.

    Since he acted so poorly, I would report him as a non-selling seller LINK to eBay for reporting non-selling seller.

    The seller should have emailed you and dicussed the situation before relisting the item.

    I agree with Steve, since he didn't contact you and was an ass about it.. Report him...
    It is not exactly cheating, I prefer to consider it creative problem solving!!!
