Should I neg this Ebay Seller?

On Oct. 5th, I bought a Seated Half Dime on Ebay. She didn't take Paypal so I mailed her a money order that same day. Her ad stated that she only shipped on Saturday, so I figured it would be shipped out that following Saturday. But she claimed she didn't get my payment until Mon., Oct. 11th, so then my item was supposedly shipped on Sat. Oct. 16th. But I still have not received it and it's been 3 and a half weeks. She says there is nothing she can do as I didn't specify insurance (her shipping cost was $4.00, but she says she shipped it regular 1st class mail).
She has over 2,750 feedback - all positive. It seems like she would want to do something to make it right to avoid negative feedback. (She still hasn't left me any feedback, although she acknowledged receiving my payment). I have never bought a coin on Ebay and not received it. So what should I do?

If you Neg her she will Neg you back can you afford that.
I saw one big seller and all his negative answers were, " you didn't buy postal insurance"
Makes you kinda think if you don't buy it you're not getting the item.

I had a registered / insured coin I sold to someone lost in mail. I mailed the coin 04/05 /04 and filed claim 30 days later. I refunded right away and am still fighting for my claim.($78)

I really don't see how she would have the right to neg me since she admittedly received my payment. She could respond that way to my neg comment, but I don't see how she could neg me?
I also wonder why she hasn't left me any feedback yet.......most sellers do right after they receive payment.

Say this: "I realize that I did not buy the insurance, wheither it was an option or not. Your liability ended as soon a you shipped the item. In that light, please forward to me a copy of your USPS receipt proving that you shipped the item and I'll handle it from there. In the absence of said receipt, I'm holding you responsible for either shipping the coin and providing proof thereof, or providing a refund. Thanks..."
This usually gets some results. If they refuse so send the coin or a refund, report them to e-bay as a non-delivering seller. Unless they can prove they sent it, they have nothing to prove their case and make you take the fall.
You had an obligation to pay,seller has to ship it (and prove it) !
i ship nothing without insurance,wether you pay for it or not.
The dealer failed to protect your interests (and hers too) by not insuring, tracking, or delivery confirmation, which could have easily been included in the $4 this sleazy ripoff dealer charged you for shipping, probably only cost $1.50 to ship in anyway.
You didn't get your item and the dealer tells you *too bad so sad GFU*
What part of getting ripped off do you not understand? If I saw you on the street and punched you in the nose and snatched your purse would you have to go make a thread on the board asking what you should do about it?
A neg is in order.

Even though you took the high road and claimed responsibility it's not the seller who "legally" needs to get the item to you. I do believe it's fishy it took so long to ship, and then never arrived. In the freight, mail, shipping world, there's a term used. Transference of ownership. After something is turned over to a carrier the original shipper has no responsibility for loss or damaged, it moves to the carrier if liability is transfered, or directly to the consignee (individual receiving the item). There's always fighting, and lawsuits going on between all three parties and probably always will. Best bet is to have all the available knowlege you can when shipping and receiving to save your hide.
Truth be it, what most have said is true. She hasn't left you feedback in case you don't reply positively. It then gives her recourse to come back at you. I think that's a crock too. As a seller, no matter what, I always leave positive feedback once clear payment has been made. Regardless of whether or not they come back after the fact.

Not true. Armen Vartian discussed this in his Coin World column a few years ago. The UCC says that a dealer (someone who is in the business of selling coins for a living) is responsible for delivery, unless offered insurance is specifically declined. If insurance was not offered, it's still his responsibility to insure delivery. OTOH, A hobbyist who sells a few coins on Ebay is not held to the Uniform Commercial Code, and if shipped uninsured, is not responsible if it never arrvies.
The FTC does not say that if the buyer does not receive his product then he is just SOL.
The FTC says a product must be shipped in less than 30 days or a refund offered. If a monies are refunded, and this just goes to show you how crooked coin sellers are all money is refunded and that includes shipping , handling & insurance charges. So much for the restocking fees and refund minus shipping that the dealers shank you guys with, huh?
The 30 day clock does not start when the check clears the bank the clock starts when the order is received
Since the dealer can not prove she shipped the coin she basically didn't ship it because FTC says a sellermust keep records and perhaps cherwood needs to contact the FTC. BTW, it's a $11,000 fine for not compling with the FTC regs.
I have never purchased insurance in the past as the coins I purchase are all fairly inexpensive and I've never had any problems. Maybe I'll rethink that next time.

There is a myriad of different negative phrases to choose from. Bottom line, accept the shipping charges and pay extra for ins. or don't bid. $5.30 is high for s/h/i and my bid would reflect this fee if I chose to bid. As a powerseller, I use delivery confirmation and save every receipt (two forms of proof that the package was sent on the date specified). Ask the seller for a scan of their postal receipt proving it was sent on the date they said it was. They should be able to provide that.

She would know a claim with the postal service for mail fraud is coming her way as well as a complaint with Ebay.
She would also know a neg is coming her way. You can respond to her neg as well.
If you word you neg and your responce right she will really look bad and you will look to be the victim.
Don't put up with this kind of crap.
It's not looking good so far. Sometimes just a phone call can clear things up that e-mail can't.
