Am I just SOL?

I bought an item about six weeks ago on eBay and paid immediately with Paypal. The item was to be sent to a friend's address, and I made that very clear in all email and paypal communication. The seller assured me this would be no problem. I waited and waited and nothing arrived. By the time I was upset enough to do something it was past the 30 day Paypal deadline I've read about on this board.

It wasn't a high dollar item at all, but it's still frustrating as this is the first time I've been screwed on eBay. The seller said it was shipped and that I should have bought insurance. He did give me positive feedback, but I haven't left any for him yet.

So, what do I do? Is my only recourse leaving him a neg?

    If the seller did not use some kind of online delivery confirmation, you can get your money back from paypal.

    I thought i read somewhere that you had to make a Paypal complaint within 30 days.

    I got paypal to reverse something after the 30 day period - they will take your complaint and tell you at this point there are no guarantees. Did you use a credit card thru paypal or your bank account? I also did the reversal thru credit route at the same time.
    The specific in my case was Kane04 - and they did take the money back - he was let's say...less than amiable!

    I was screwed and strung along by the seller (import-export-co, if you're interested) until the 30-day chargeback period expired. Despite all the ironclad proofs I offered that showed the seller never shipped the item and in fact resold it on eBay (same SGC serial #), PayPal said they could not make an exception. As far as I can tell, no action at all was taken against the seller.
  • I've about had it with the bogus "insurance" argument. I always insure valuable cards I send through the mail. At least I will get my money back, and I will be able to reimburse the buyer if he has already paid. If you ship a valuable card, and it doesn't get to the buyer, that is not the buyer's fault. IMHO it is the responsibility of the seller to protect the product and ensure the card or a reimbursement gets to the buyer. Add the cost of insurance to the postage fees. Most sellers are making beaucoup percentages on postage fees as it is. Any time I read where the seller wants me to pay for insuring the card, I don't bid.

    ParrotPaul - this is one of those muddy areas. Factory product is usually shipped FOB factory, which means as soon as the material leaves their loading dock it is the property of the consignee. I'm waiting for a valuable card now that I didn't insure - we'll see what happens. Fortunately, it was only a week or so ago and I paid thru paypal.
