Question of "Who's at fault"

I bought two tickets to the Falcons Rams game for this Sunday 09/19 on Tuesday afternoon 09/14 off eBay. The guy lives close to me but wanted to ship them so I paid $8 for 2nd day FedEx. They were supposed to arrive this morning by 10am. They never came in. I'm hoping they come in tomorrow, but if they don't who is at fault? Assuming that they were actually mailed, do I request that PayPal refund my money due to non-reciept. This could be a problem if they come in later though. Should I go directly to my credit card and explain the problem? Also even if I get my money will FedEx refund the guys money because they screwed up the shipment.

I emailed him eariler - I'm waiting for a response. If no response I'll get his contact info. Like I said, they may still come in tomorrow so I still have hope. If they don't, I'd have to pay probably a lot more for the tickets on the street so it's pretty frustrating.
