Misunderstanding with eBay Power Seller... RESOLVED!!!

I am updating this on 22SEP2004: I am pleased to post that this misunderstanding has been resolved. As mentioned in an earlier post, our misunderstanding appeared to have occured non-intentionally due some communication mis-haps. Once cknol1 and marketables.com was aware of the situation, he responded quickly and professionally and made the situation right. Based on this very positive experience, I want to say that in my opinion cknol1 and marketables.com are one of the GOOD GUYS on eBay! I have confidence in this seller, and would not hesitate to do business with him again!

Anybody do business with eBay seller cknol1? Mailing address marketables.com Cincinnati, OH? I lost money with this guy during an earlier auction and am wondering if there is anything I can do about it....
This occurred in April of this year... I won 2 Yahoo auctions from seller zackbo1119 in the amount of $64.68, for two nice Franklins. Check mailed in.... and as you guess, nothing. No coins, no response to repeated emails, and looked like the seller closed up shop in the classic ripoff of selling a few items and then disappearing with the money. The check was cashed, and no coins. The original email I received from this seller notifying me of my winning bids had 'Zachary Nolte' as the sender.
Now fast forward to a week or so ago. I won an auction from seller cknol1, a power seller. Received the notification from the seller.... and it is from marketables.com Cincinnati OH!! same PO box and all!! So this is the same guy who ripped me off on Yahoo.... doing business on eBay. And what I don't understand is this guy is a power seller with over 5580 feedbacks!
I emailed him letting him know that I had won his auction, but would not be sending any money until our... previous transaction.... is completed. That was two days ago, and surprise, surprise.... so far no response. Looks like the same old ignoring email business.
So, what can I do? Since I won an auction from this guy, I have considered leaving a negative feedback. But is this an appropriate thing to do since the auctions in question were from Yahoo? And even if I did leave a negative, the guy has enough positives that it will only look like I have a unwarranted grudge against the guy. And of course I will get a negative in response. Any suggestions? Anyone know this 'Zachary Nolte'?

I believe you should use every legitimate vehicle at your disposal to remedy the situation and/or forewarn others.

2 follow through with your eBay obligation use Paypal if possible. If you don't then you leave yourself open to being penalized on eBay.
3 Check with your bank concerning the check written for the yahoo auction. Some states allow you to file a "reverse payment" on checks just like can be done with credit cards. There may be a time limit on this and it is highly dependant on if your bank will cooperate if the state you bank in allows it. Mind you if you file a successful reversal and the seller can prove shipping even though you did not receive the item you leave yourself open to whatever your states "bad check" laws are.
4 If you follow through with your eBay obligation and the seller is a nonperformer <again> file mail fraud again and use eBay's methods to recover.
Too bad you didn't recognize the guy before you won the auction it would have saved you some grief. Since the Yahoo transaction and the eBay transaction are unrelated transactions you are unfortunatly bound to eBays rules concerning the eBay auction. Bottom line eBay won't care one bit if it is the same guy who scammed you on yahoo.

It's truly funny, no make that truly sad, that people in this day and age are so wrapped up in their own little world that they refuse to try and teach someone else the correct or accepted way of doing things.
Thanks for some very good suggestions. Yes, if I knew this was the same guy, I certainly would not have bid. But unfortunately, there was nothing that triggered any recognition on my part on his listing.
I realize that bidding on eBay forms a contract... and one is bound to it. But I just don't think that I will be sending the guy more money. Kind of like the old saying.... the first time I get taken, shame on them. The second time I get taken.... shame on me! I prefer not to risk it again, even though they have power seller status and for all practical purposes appear to do a lot of satifactory business. My business with them has shown otherwise.
Actually, I am not refusing to honor my eBay bid/purchase. I will be glad to complete the transaction.... as soon as they will make good on their previous obligation with me. After all, I do not think eBay has any exact time that a transaction MUST be completed, so I figure I can wait until this gets resolved. I will be glad to work something out with them.... but I am willing to bet they will continue to ignore their obligation.
If I do not hear from them shortly, I will file a complait with the USPS for the Yahoo auction. Although I realize that will not get any action to get my money back, at least will give some satisfaction.

Too many folks won't make that phone call and discuss it person to person.
Email is great but sometimes it just don't get things fixed.
1-No matter what you thing of the guy and would really like to say to him, don't.
2-Start off with a very polite request for whatever is fair on both sides.
3-Let him know you just want to break even and you will be happy.
4-If he will not work with you forget #1.
5-Tell him you have the mail fraud forms ready to go.
6-If needed start filing the complaints.
7-Save ebay feedback for the right time.
8-Forget it.
Just my way of seeing the situation.
Use the eBay - contact Seller and get the person's address and phone number.
Gather all applicable data/paperwork for previous Yahoo auctions.
Put copies of all info to him in the mail. Then call him and tell him you have mailed reference materials for the products owed to you.
If mail comes back/wrong address - report to eBay.
If he doesn't make good on it - file fraud with USPS and Yahoo (you didn't do that before already?? - Why prolonged wait on this???)
(remembers always: Time is money!)
Tell him that you will be holding payment for the eBay auction until things have been settled regarding the Yahoo.

Your idea sounds great. But I plan to modify it a little: I'll make a copy of the info, including cancelled check, and send in 'as payment' for the coin I just won. I figure I have about $64 in 'credit' coming with the seller, and the coin I won is around $55, so they should just send me the latest coin I won in auction.....
As most of you know, it's not just the money. When we play on eBay we expect to get burned once in awhile. Definitely not the first time for me, nor my biggest loss. What got to me.... is that I inadvertently won another one of their auctions..... grrrrrr.......

I know of very few businesses with a postive track record who haven't screwed up once in awhile and even fewer who haven't worked to resolve the situation to the satisfaction of the client.
Please keep us updated on what happens. I think we would all like to know if this was simply a mistake, so that chknol1 (ebay) will have a clean record.

Tincup, you were apparently concerned enough to post here, but now that you have received much advice AND a most courteous reply from the seller, you "will try to contact" him "in the next couple of days"? Why not sooner and why not change/correct the title of your thread?

Mark, I worded it this way due to the nature of my normal day job.... it typically starts at 5:00AM and can run past 6:00PM on some days; it is not an office job and not always conducive to making this type of phone call. My intent was to call at the first reasonable opportunity.
Actually, just got off the phone with cknol1 just a little bit ago. I found cknol1 to be very reasonable and easy to talk with, professional, and he does take his business seriously. At this time, we do not know why the first Yahoo transaction turned out the way it did, other than it truely looks like communications somehow just did not get through normally. So rather than try to figure that out at this late time, we have an agreement to resolve the matter. I will give a final update when we finish up with it.
At this time, I will say that cknol1 is really looking like one of the good guys. Thanks cknol1, for giving the chance to work this out.
One thing I do want to mention-- when I posted this on the forum, it was not my intent 'flame' the seller. (well, I guess I did get carried away with the work 'jerk' in my opening post.....) Rather, my intent was to use the forum members expertise to help point out the best ways to approach this, any of their previous experiences with the seller, or any obvious things that I may have neglected to do. I have seen many good answers given not only on this thread, but on many others. This forum is great for that!
Might I suggest changing the subject line to reflect this? If you're convinced now that he's not a ripoff artist, why give someone new to the thread the idea that he is? If they don't read the whole thread, they might think he's scammer even though you now believe otherwise.
