    He would have politely refunded the payment and told you that it was a mistake. It's happened to quite a few of us.

    Which would be very ironic after he included this clause in his item description

    "By placing a bid you are in a binding contract and agree to the terms and conditions stated."

    That's what I say. Both Ebay and the sellers are fond of pointing out that bidding constitutes a contract, but I don't know of any state that enforces one sided contracts. If I bid, and have to pay, then you as the seller have to sell me the item at the agreed on price.
