Are we talking who ACG is going after next OR which TPG/Dealer/Telemarketer someone will go after next using the recent court decisions that have been discussed on this forum?

    hey Michael

that would be the latter. after it all plays out and a precedent is in place---one way or the other---i wonder if their will be some effort to force legitimacy on the various services. the best approach would most likely be with an enforcement of ANA standards.

    You raised two issues --

<< <i>i wonder if their will be some effort to force legitimacy on the various services. >>

It is certainly possible that if ACG loses a countersuit and its determined that their grading standards do not bear relationship to the "industry standard" then quite possibly that precedent could be used as starting point for other types of similar suits vs. other TPGs. It wouldn't be limited to just the grading standards use, it could open the door to a myriad of different types of suits. The ANA has to becareful, in my opinion. This could backfire and harm some of the larger, more legitimate players.

These will be used in any litigation as what's called "industry standards." Liability might be determined by how far from these standards does one stray. Grading might be subjective -- but it is standardized so there's a measurable component to it. Though I doubt if the ANA would be enforcing them -- that's better left to the free market economy and the lawyers.

Though if I owned a TPG and were not grading as accurately as I could and ACG loses -- I'd be worried.
