newbie, ebay ripped off, advice?

I am hoping you ladies and gentleman can give me some advice, by the way this is my first post. I purchased a 10gram gold credite suisse gold bar from a member on ebay on July 3rd. I made several attempts to contact him by phone and email with no response. I finally decided to block my number when I called him and low and behold he answered. I asked him(sounded like a kid) if he had a tracking # and he said opps I forgot. After some talking he said he would ship it today and call me with the tracking#. He didn't and I have left him 3 messages. I am new to paypal and ebay with only 20 feedbacks and have filed a claim with paypal. I also contacted the fraud division of Beverly Hills PD and the officer said to call back on Monday to talk to a detective? Should I call back or wait?? Am I jumping the gun or should I let paypal run its course. I am just so P.O. it isn't even funny, this is the second time this has happened and I just want people to be responsible. Any advice would be appreciated. I know I have to be more careful who I buy from on ebay so please don't flame me so much image

P.S. I bought the PCGS gold package and sent in four coins for grading, with the free coupons how long does it normally take to get the coins back?

    Welcome to the boards! Hopefully PayPal will take some action... eventually--since he hasn't called you, I don't think you jumped the gun. I hope it all works out.

    As for the gradings, about a month to have your grades back--mine should be done this coming week, and they went in 6/19.

    Welcome to the boards AR18 - by all means pursue this fraudulent transaction to whatever ends necessary. Ebay should be handled as most people handle a middle eastern bazaar - with eyes on the back of your head - never take anything for granted. As for your gradings, they should be done in 15 business days from the time they hit the doors at PCGS (maybe image) Have fun - you can learn quite a bit here.

    You just did the best thing: joined the forum.

    As others said---1 month for the free submissions.

    The eBay issue will be resolved--eventually.
    Seller needs to prove he sent item to a confirmed address (Delivery Confirmation or some other way).

    As in most situations--ask questions before you do anything--then be careful.

    I don't think anyone's gonna risk fraud charges over 10 grams of gold. I'm not a big fan of "grams", but isn't that about the weight of a paper clip? Maybe $30? I think if you ask to speak to a detective over an Ebay auction that's 2 weeks old, involving a $30 gold flake - you're gonna redefine the word "paranoid". I'm not too sure they're going to devote a crime lab in L.A. to this heinous offense either.


    In other words, I think I might give it some time...

    I stand corrected - $130. I don't even consider sellers with private feedback or that hide bidders identities.

  • Sorry to hear of your problem. Do what you think is best, and if that includes calling the police then do it. I'm leary of any seller who keeps his feedback private. I have had sellers put the bidders IDs private when a high dollar coin is being auctioned off. Thanks for warning us of this seller.

  • You're wasting your time going to the police. The local police don't have jurisdiction over the seller unless he happens to be in California. Besides, you would have to prove that at the time of the sale he had the specific intent to defraud you. If he just decided to not follow through with the deal, then it is just what is called "conversion", which is a civil tort, not a crime. The only way to get past this is to show a pattern of conduct on his part where over a period of time he has done the samr thing to others as well as to you. Then his intent can be inferred by his pattern of deceit.
    Good luck. PayPal is your best bet for recovery.

    he cannot find a picture of the product so he borrows one from google that is "like it."

    his english is not very good.

    his email address seems absurd: electronicsdorkhajie????

    has private feedback

    I wouldn't have bid....but if I did....I wouldn't have waited 2 weeks on this jamoke.

    update, I decide to use another source and indeed find his home phone number. I called and his mother answered and was very sorry, she said her mother was in the hospital and her son informed her of the situation and she assured me that I would be shipped on monday when I mentioned I was glad the police didn't have to get involved. She took my number and said she would call me on monday. I sent an email to her son and told him to provide a tracking # to paypal complaint snd I DID NOT cancel the complaint just in case. I am not sure if this is an unfortunate situation for the family of a family scan. Thanks for all the advice.

    I am sorry to hear of your troubles (I've been there before), but it sounds like you have a good handle on this situation right now. And your instincts not to cancel ANY action against them at this point is prudent. Give them a chance to make good, and if they don't, then do what you need to legally. I wish you the best!

  • Welcome to the boards ar18. Hope you get this worked out. I got nailed for about the same amount a couple of years ago on some coin rolls. I filed fraud reports at both ebay and paypal. Never did get my money back. But it taught me to be a lot more careful on my bidding habits. Now I check feedback closer and the sellers length of time on ebay. I don't bid anything new sellers put up for auction. Its sad because not every new person to ebay is a scam artist!
