Unbelievable seller that accepts Paypal

This is update on a thread I post several weeks ago about a purchase of $57 that I paid with paypal to this seller. I had filed a claim with Paypal for non-receipt of items on the 27th day. The package arrives 45+ days later with footprints, boogers, etc after taking the scenic route around the country. I emailed the guy to tell him that I have received the package 45+ days later and being an honest buyer, I felt that I had to do it even though the shabby service (no tracking #, confirmation, and slow email replies). After he got my email of receipt, he files an appeal with Paypal because he got kicked off or suspended from ever using their service. The appeal was dismissed/dropped within 7 days. Anyways, I get a phone call from my local sheriff's dept. out here where I live early this morning and hard to comprehend the conservation due to last night's drinking fiasco. Bottom line is, this seller is now crying because he got suspended from Paypal for not following their guidelines/terms and wants to use paypal again so he had to go thru these means. There's nothing I can do for his appeal since Paypal can only accept the appeal by providing them with a tracking # to my confirmed address which he cannot do since he never did send it out with tracking or confirmation. (.60 cents for $5 postage paid). I left him 2 big fat negatives for the early phone calls by the Sheriff (Sheriff laughed as I explained to him the scenario, and said it's in his hands now but had to hear both sides). What the seller wanted me to do was to drop the claim, which was dropped by Paypal....there's nothing for me to click on or add....it had been dropped weeks ago after they found him at fault. As a buyer, I cannot call Paypal or resubmit a non-claim because the bottomline is...the seller must provide proof of delivery to a confirmed address. So for all you sellers out there, please send with confirmation....it's only .55 cents. As for the famous quote "seller is not responsible for lost or damaged items if not insured"; that's fine. I don't care if it got here damage; just show me the proof that it was sent out in the first place. Sorry, I needed to vent.

  • It doesn't sound like delivery confirmation would've saved your package from getting lost in the postal system for 45 days. The seller shipped the cards like he said he did. Why do you feel the need to continue to punish him when it's turned out he did nothing illegal? You got the cards. You got some money back too. Don't you owe him something now for the cards you now have?

    He did nothing illegal. Neither did I; but his statement to the Sheriff was I was dealing with credit card fraud. How am I punishing him? He punished himself for not following Paypal's user agreement. Neither party has any control of the postal system. Yes, I got back a total of $4.80 which was sent back to him via the mail. Hopefully he'll get it within 45 days.
  • I am not sure I understand. Why can't you write paypal and explain that it was a USPS mistake, and ask them to reinstate the guy??

    I have done that. Sent PP an email stating I have finally received the items out of good faith (I could of kept quiet) and I'm sure the seller has also told them that on his initial appeal that items were rec'd. I haven't heard back from PP so I disregarded it because IMO the case is over. If the "view case" icon had still been in effect under my account, I would of clicked "cancel" but it is no longer due to so many days have passed and the case closed. I think (pretty sure) under PP's agreement, it says that goods must be delivered within 7-10 days after receiving PP paypment and all goods must have tracking or signature confirmation. I remember reading the summary for his appeal. It said " we are currently reviewing the seller's appeal for case # XXXXXXXX and will decide our decision once he has provided tracking information to your confirmed address. No information is needed from you at this time and we will contact you if any is needed". Everything on my part has been done. PP made their decision and now he's harrassing me. What more can I do?

    As I see it he was 100% sure he sent you cards. It's possible they could've been lost, but it's also possible that you could've got them and claimed you didn't. You did what you had to do in reporting the matter to Paypal as a fraud and he did what he had to do in reporting the matter as possible fraud. Now that it is clear that you are both not crooks you can help each other get on with your lives.

    The good thing about ebay is that it connects you with a huge, worldwide market with millions of people.

    The bad thing is that a lot of these people are freakin' psychos....and they all have your home phone number and address.

    Luckily, we're all making so much money from that site that it's all worth it. Right? Right?

    I think you did about as much as you could at this point.

    That is creepy, but what's kinda funny about that whole thread is all the people saying "oh yes, we've all had our share of wacko buyers... don't let it scare you away...blah blah blah." I don't think 5 people on that entire thread had more than 15 FB, and most of them have only been members since March 04. Just had to point that out, I thought it was funny.

    EagleEye, I would say you've done what you can, the seller was obviously trying to cover his a$$ when he filed the CC Fraud complaint, for $57 I wouldn't even bother but to each his own. Seller probably deserved the negs and you'll probably get a couple in return. I would just do what I could to now help him settle it with paypal. You got your cards and obviously he wasn't the one taking the Wells Fargo buggy around the country to try and get it to you so try to help him out if you can. Not sure if there is anything you can do anyway but...

    That's just it. I think he did it for intimidation or tried to scare me tactics. He told the Sheriff (I live in the butthole desert), I was pulling a credit card scam....therefore the phone call. I didn't pay with a credit card....it came out of my checking account. That's what made me mad.
