Legal recourse against NPB's

what legal recourse, if any, does a seller have against a buyer if the buyer doesn't pay for an item? can a seller "force" a buyer to pay up? i only ask after noticing this in an auction description-

Non Paying Bidders: We will report all non paying bidders to eBay and give their accounts to a Law firm for collection. Bidding on eBay is a binding contract, please do not bid if you do not intend to honor your bid. Not honoring a bid could lead to suspension from ebay and it can also ruin your credit.

    Its (and I am no legal man by far) hard to do "across" state lines. Different states have different laws I believe regarding this. While it may be considered "mail/internet" fraud, how much would someone in their right mind spend to get $50? It is probably depending on the "value".

    May I inquire as to which auction? I have also seen this and just went "ooooooo scary" in a mockingly way. Because it either means they have been burned (yet Ebay refunds their monies if they do it right) or they are not on the "up and up". But that is just me.

  • Basic UCC Law. It is fraud and a breach of contract if they don't pay. You can file suit against the buyer (if they are legitimate and you can find them). Usually the state where they are from. The amount you can collect above the closing price varies from state to state. It also depends on whether you file in small claims court or not (small claims is usually capped at $5,000.00 and there is no lawyer involved). It just becomes an issue of whether the value of the card (I am assuming in this case) is worth crossing state lines to collect. If we are talking about the Koby/Lebron 1/1, I would have no problem going after that NPB($65,000 and counting). image
